Philipines Consulate add extra fees on HK employer
My helper told me last year, we have to pay the OWWA (Overseas Workers Welfare Administration)membership fee for them. She said it is compulsory to do, even I go to the Philippines consulate, the OWWA people also said they pass the law that the employer have to pay for their helper. (but before it is paid by the help) I have checked with Immigration dept and Labour dept, no one knows what is OWWA and no law change this few years.
This year my helper get me a letter issued by Consulate general of the Philippines and said it is "the employer shoulders payment. And the payment is stipulated in paragraph 8, line (v) of the standard employment contract......
Actually, it only cost $200. I don't mind to pay that amount and she is not asking me to pay for her. To be honest, I pay more than the basic salary and I give bonus to her. But I found that it is too easy for them to add any extra cost to us! I also checked again with HK immigration and labour dept this year, no one knows it too.
You know all the helpers from other countries are very well protected by HK govt (not include the exploited indonesian). If they are hurt after work, like on Sunday, you have to pay ALL for her. Some insurance are not cover if they are not working for you. BUT bear in mind that if she is still under your employment, labour department said the employer should bear all the cost, even the accident is happened during her holiday.
So all the domestic helper in HK, to protect yourself, don't release earlier before they finished contract. If they really need to take their annual leave right before finish contract, don't forget to send the termination letter to immigration and pay her the rest of the annual leave.
