菲傭懷孕了! 怎辨?

菲傭最近發現懷孕4個月,她提出停薪留職回祖家生BB後再回來. I can't accept as I can't hire another maid.
She is renew my 3 contract and entitle 1 mth vocation. After 1 mth vocation, she comes back and have 4 mth baby.

I can't cut her and she don't want to termate the contract but she comes back after 1/2 yr.

What can I do as I want to terminate but illegal ?

我諗妳都要接受佢既條件啦.佢係香港生重麻煩.懷孕其間,就算佢唔做野,妳都唔炒得佢.係香港生,入院費要妳比.生完之後前四後六.妳到時要照顧佢既BB同服侍佢坐月.要炒都要係生完之後先可以炒.我之前就有個朋友係咁啦.死未?

She don't give birth here but request to come back when the baby is 6 mth.

Is it accepted by immigration?

There are two options you can think about it....

<<<<Terminate her contract>>>>
You can not hire another domestic helper during her no paid leave and maternal leave in Phillipines except you have enough finiancial support to employ two domestic helper in the same time.
You also have all liability on her performance even she is on her no paid leave in Phillipines. If she has sick or accidenant in Phillipines, you also have that liability. For confirmation, ask legal suggestion.
If you terminate her contract, here are the compensation.......
(a) One month Notice or salary
(b) Last month salary
(c) Pro-rata Annual leave compensate
(d) Long term compensation, if applied
Last month salary x 2/3 x no. of years
(e) One way air ticket back to Phillipines
(f) One day Travel & Food allowance
(g) 4+6 Weeks Maternal Leave compensate

<<<<Make a neutral agreement with her>>>>
She try to explain it to her in peace and in details. You will employ a new domestic helper for 2 yrs when she back to Phillipines to delivery her baby and take care the baby untill 2 years end. You will re-employ her again after that. I know it's a hard to let her make such decision but you try your best.

媽咪,

You cannot terminate her contract now after she has informed your of her pregnancy.
She is protected under labour laws just like us.

The earliest you can fire her is when she returns to HK AFTER delivering the baby.
If she wants to fly back to the Philippines to delivery her baby, she should pay her own return airfare.
