your maid cannot find another employer if her contract is terminated. According to law, she has to go back to philippines before another employer can apply for her. Recently, the immigration has tightened the requirements such that even for financial problems of the employer and the maid is dismissed as a result, the maid still has to go back to Philippines first. For those who have dismissed the maid on finanical grounds, it is difficult for them to apply for another one at once as the immigration would not permit. pl check.
For termination letter, there is a standard format in the Ordinance. However, just a simple letter setting out
(a) the reasons of early termination
(b) contract termination date
(c) and signed by the maid
Of course, you need to hava a separate receipt confirming that all payments including payment on compensation leave and holidays and airticket and signed by the maid
u better states a reason if not suitable in what aspect she is not suitable such as not taking care of kids properly, cheating, telling lies, not doing housework in accordance with instructions.......
For second question, not exactly. you may terminate a maid without issue of warning letter. Instance such as stealing and you have evidence, hurting the kids etc, for these sort of things, there is no point of issue warning letters but fire immediately if the incident is serious. However, u must been seen to act in a reasonable manner otherwise the maid may charge you and take you to the relevant authority such as immigration, labour etc.
