But one point for others to note.
The website indicates that there is no need to pay stamp duty for such property transfer.
This is incorrect.
Even though the property title is transferred at nil consideration under a court order, the recipient still needs to pay stamp duty. IRD will assess the property value and then calculate the stamp duty that needs to be paid. However, with a court order, the recipient only needs to pay the basic stamp duty rate (i.e. no "chilli" stamp duty if you have more than 1 residential properties).
