No, I won't give my helper increment. When she takes leave, I will only pay her upto the day she leaves HK, and then pay her the rest of her salary when she returns to HK. Furthermore, I will give her bonus upon renewal only after she returns to HK. And according to labour dept, your helper could only take the no. of leaves for the period that she has worked for you, i.e. on a pro-rata basis. In advance leave does not comply with law.
According to the officer of Labour Department, during the second year of contract, your helper can only take the 7 days annual leave for the first year. The other 7 days must be wait until the whole contract is finished.
