向走老貨車司機追討法庭裁決後欠款???

A year ago, we had a car accident, the 16 ton of medium goods vehicle hit my car trunk, 法庭裁決後, ( from Small Claims Tribunal 小額錢債審裁處), we are the claimants and the lorry driver and the owner of the lorry both are the defendants (被告人), they need to pay the claims included the rate and all the fees.... in the period of days.
Unfortunately, the driver refused and ignored the order and claims. He even refused to report the case to his insurance company and paid the minimum payment for NCB.... So , my husband and I want to take the action from 執達吏 , 追討欠款. 你地有無遇過走老司機, 拖住條數吾理, 真氣頂

the other driver should pay the fees to the Small Claims Tribunal, and then you collect the amount from there. what did the Tribunal clerk say ?

唔該晒 Evolution 的回覆.
Small Claims Tribunal sent us the Form of Award/order on Jan 23, 2006.
The result is
Between (a) our names xxx Claimants and (b) xxx ( the car 's owner and xxx the driver Defendants

本審裁處作出以下裁決/命令:
兩位被告人在聆訊時缺席, 現頒令如下:
兩位被告人須支付申索人:
款項 34851.10元,
上述款項的判決前利息,以判定利率計算, 由13/9/2005計/至23/1/2006.
訟費290元.
上述判決款項 ( 包括判決前利息及訟費) 的判決後利息, 以判定利率計算, 由裁斷日起計至款項付清時止.

Their addresses are sent to us , we can apply a form of Writ of Fifa. I don't know what we can do now..... :-(

you can read some info here

then you can consider your position.

i suggest you do a search again, about the owner of the truck. if still the same, you have a good chance to execute your rights ?

another question - what did the police say ?

I've checked the link you listed. If we apply for the writ of fifa, the cost we need to pay is $5200. It is not guarantee the owner of the truck and the driver are still staying / living the place where the address is given to us. If not, we still need to pay the fee $800 ( New Territiories ) / each call or action.

My hubby and I still consider whether we take further action or not. If we know where they parked the truck, I am sure they can pay for it. But I am worried about they changed the car plate no. then...... we lost everything..... :-(

My hubby told me tonight that they even haven't paid the registration fee for an year.........Bad news.... they do not want to keep the car .
