Finally settled with my maid. She paid me one month salary - nett off by what I should pay her (air ticket, allowance etc). Based on the overhead hiring her (visa, air ticket.....), her monthly salary ...

Update 1: HKPF refused to handle the case as the original of the fraud document is kept by Canadian Emb. I am waiting for Canadian Emb's reply on whether they will report the case to HKPF but I only received a reply saying the case would be forward to responsible officer.
Update 2: My fd working in Labour Dept. told me that even if HKPF is willing to handle and investigate and charge her, as this "fraud/dishonest" is not related to her work, I cannot use this clause to exempt myself the one month notice/salary if I fired her.

Right, reference letter from current employer is not required.
Since my maid and I couldn't end the case in good terms - I have written a 2-page letter and sent to Canadian Consulate by fax & email stating her wilful misconduct. I have no clue how the Consulate looks at the matter. I have done all I should. I just stated the facts. If the facts are not enough to change Consulate's stance, so be it.
I just want justice and fairness and that we all respect the spirit of contract (she should give me one month notice instead of walking away like that). My maid refused to give me her resignation nor sign my termination letter last night. She has run out of options after consulting her friends. She finally resigned to me this morning.
It's unfair that I have to provide her air ticket during peak season in Dec. Labor dept confirms I have obligation to pay her in 7 days, yet the law does not say any deadline when she should pay me in lieu of notice. So I may have to pay her in cash for the air ticket (which I really want to issue ticket instead).
If anyone has tips on how to arrange the cheapest airfare (I have to pay round trip though literally she will not use Philippines to HK), please let me know!
