你有新工後請老細寫Employment Letter給你証明你月薪，再加你先生既入息證明，另外你寫信告知入境處點解你無稅單及唔夠入息證明，因你過去1年多沒有工作，但現在因找到全職工作，所以要請工人幫手，通常都會批俾你。再唔係有無有入息證明既父母兄弟姐妹，可幫手做保証人Sponsor?如有就一定無問題。

Dear Mrs Rose,

I still can't find a local finished contract maid. Many of them didn't want to take care 2-kids family:( and back out always at the last moment. Today I got a referal from a friend's maid. She has finished the training and can come any time. I have a few questions:
1)Since I have paid $3xxx to the agent, Isurely want the agent to arrange the details for direct-hire so I can save more money. The agent said I don't have to pay anymore. However, the maid in Phil has to pay HK$3200 + around HK$1600 training fee. So the HK$3200 has to be paid by me first and the maid should give me when she arrives. Is it normal?

2)If I give the expedition letter to immigration, how fast is the process time that the maid can come to HK?(She has worked in HK8 yrs and gots HKID.)
3)Actually I have selected 2 different maids and submitted the contract. But both are back out. Will this affect my application time from HK Immigration?

Warning Letter

Just want to check for my friend :

Her maid has stolen money from her last week. My friend wants to give her maid one more chance and keep on use that maid. But she wants to issue a warning letter to her maid mentioning that if she commit the same things again, the contract will be terminated immediately without any notice period and notice payment.

Can she do that ? Because the maid has stolen money one time already.

Hi MrSROSE,

我個印印前天就自己帶阿B落街(我請佢時講明唔可以私自落街), 去SHOPPING買野. 我打回家無人聽電話, 一個小時後有人聽, 我問印印去左邊, 佢話肚痾, 我問佢唔舒服呀, 去一個鐘咁耐. 佢又話唔係, 可能飲左咖啡.

後來我回家發現了有D蛋糕紙 (即去左麵包店買的), 問佢點解要落街, 佢話想食公仔麵, 但我家中是有的. 佢仲要一路講大話話落左樓下(無去太遠的地方). 但我發現佢買左包魷魚係惠康牌, 所以我即時踢爆佢話呢個牌子樓下無得賣. 佢先知話去左惠康, 仲買左只VCD.

我依家警告左佢, 話再有下次要炒人. 我想知, 可以點寫張警告信俾佢. 係唔係要中印並重. 請教路. 謝.

請問炒工人一事:

預計2月2日炒, 我於四月二十六日2007請她, 補錢計法如下, 正確嗎?
1)
大假: 277/365 x 7 days = 5.31 days (是給5 or 6日大假)
2)
補一個月代通知金 ($3400)
3)
要補單程機票:由 HK to Manila, 另由於炒之日臨近新年,機票可能會貴些, 我應補多少機票$她? 有無good air ticket agent 介紹? 另她合約之住址為: Pontevedra Negrus, Occidental. 應給她多少$買內陸機票?
4)
是否炒她便自動有14 日留港, 不用入境dept. 批?
5)
有否解僱letter sample給我?

夠$15000當然最好一個攪掂，但真係唔夠就要加埋你先生既入息證明先可以。另入息證明係出示最近三個月即可。

Hi siumyra ,

ANS: Every agent have different charges and way of handling direct hire. I can only say your agent charges is a bit higher then others. Also training fee is too high. However now that you had already made payment to your agent on the previous case, I guess you have not much choice but to follow their charges (unless you can negotiate for a refund).

ANS: This depends on the immigration officer and have nothing to do with the maid's experience. It will be more effective if you as the employer can go to the Immigration to submit the letter and talk to the officer.

ANS: If its only during the process of submission to Philippine Consulate that the maids had back out, it won't affect the HK Immigration process. But if its already submitted to HK Immigration, you have to ensure that the previous applications had been cancel, or else it will be pending at the Immigration.

The warning letter should not be written by your friend. She should instead ask the maid to hand-write the letter and willingly admitting she had stolen the money and asking the employer to give her a chance.

IF you friend want to write, she can write as a comment in response to the maid's letter on the same letter the maid wrote.

工人頭3個月唔entitle放有薪 "勞工假" 即初一初二初三、大時大節個D呀!但並唔係每星期的例假，weekly holidays係要放俾佢又要俾工資架...

你要問你個agent入左入境處未，你先可打去入境處check架，或者佢地都未入application入境處check到! 除非你有VCA 白咭 number，唔係重要工人全名、出生日期及Passport number先問倒架。另外你咁快就唔信你個agent?佢地點解要對你講大話呀你個case又唔急既。

我個印印剛剛做滿1年, 口頭上問過佢, 佢願意同我地續第2份約.

1) 我可否現在同佢續約, 政府/領事館方面會唔會辦理?

2) if not, 有無咩文件可以同佢簽咗先, 等到啱時候先同佢正式辦手續? (因以前曾經試過有個工人又係口頭上話會續約, 點知到 expire 前4個月先話唔做, 攪到好 lei hea ....)

3) 工人話續約後唔會即刻返印尼, 會等到第3年先返, 咁我要唔要先補機票錢比佢呢? 定係到佢放假先買機票比佢就 ok?

4) 我驚佢到時放完假唔返嚟, 我可唔可以扣起佢1個月人工 or 要佢自己先買機票, 到佢返嚟我先比返d錢佢?

Dear Mrs Rose,

我個印傭在我家工作已7個月,近日我靜靜set了錄影及錄聲,發現佢原來有手提電話,每次錄影佢都有講電話,有次仲講了3個機鐘,而另一次錄到她好惡咁鬧我bb(7month),但全部都係偷錄她,有一晚我兩公婆外出,因bb床在客廳,所以叫她不可関燈,因bb睡覺都要看他,但她就関了所有燈走咗去房or浴室,到我回家時又着回燈,咁點??
而她到我家第一天我家時已講明不可在工作時間講電話,其他家規都是口頭講,未有記錄及簽名:
1. 請問咁偷錄影及錄音可否立刻話她不當行為或出信警告?
2. 而她又好惡咁鬧我bb(7month)又可否話她不當行為或出信警告.
3.她又１蛀無聽我指示関了燈,但我回來時又着了燈,咁點??全部都係偷錄..
4.我可否提出以上理由抄她or我用以下理由"我家暫時不用請工人,亦唔習慣有個工人在家等..."立刻補一個月叫她走??

Dear Mrs Rose,
我個印傭將於1月12日約滿離港, 已經Agent出了機票給她, 現有以下問題想請教你:
(1) 當日她要清晨約5時半出發到機場, 是否同時要計算當日的工資和膳食及交通津貼給她?
(2) 膳食及交通津貼應怎樣計算?
(3) 新的印傭(她的姊姊)已於07年12月27日上班, 至今已放了兩天假(30/12 & 1/1), 如打算定2月1日為出糧日, 是否只可以扣她一日工資(1/1)?
(4) 新的印傭說她沒有錢, 問可否一個月只放兩日假? 但我覺得沒有需要, 因沒有工作給她做, 但仍要比工資給她! 如不應承她又怕她會問我或其他人借錢出街, 應怎樣處理較好? 謝謝!
