ANS: Yes she really no need to go back Phil., because employer dead Immigration will let her change another employer in HK and she can process the new visa without exit HK.

如果佢真係拿到永久居民 ID card，當然唔駛申請工作証啦，自由出入境亦可自由搵工!

我刚签约一个本地菲佣，工作visa已批且工人已使用该visa入境,但该工人尚未开始为我们工作，雇佣中介即通知我们发现她有几千元债务被财务公司追数。

1）我是否可以有合理理由不给通知期即时解雇该工人？有何书面文件及手续要办（如：入境处和劳工处）？

ANS:你可即时解雇该工人，但一定要支付一个月代通知金及回程机票。

2）如果工人不同意自愿解除合约，追我支付一个月代通知金及回程机票，我是否可以拒绝支付？如需经诉讼程序解决的话对我是否有利，以什么理由声张我的合理权益，及需提供何种证据？

ANS:我希望你明白借錢並唔犯法，你真係唔俾工人一定去劳工处投訢，到時你可向法官表達你既不滿，要睇佢點判。

3）该种情况下雇佣中介是否应承担何种责任?

ANS:無需要承担任何责任，Agent唔係大偵探，亦唔係先知，可能你同工人面試知得比Agent還要多，點解你又唔覺你应承担责任? 你心情我好明白，點解唔同工人傾下或者幾仟元佢會還呢、還清欠債可唔可以接受佢唔炒...

可以用你名做僱主，但用外母家地址申請，半年後合約再改回你家地址即可。改地址手續到時再教你。

I have just terminated the "bun bun" because of poor performance and ? stealing things. One mth notice(salary) and air-ticket(open to 14 days) has given to her. Does she need to leave HK if she find the new employer? Must within 14 days? As I buy the ticket thro' internet,airline will refune to my credit card if the ticket not be used. Do I need to pay cash to her if not yet used?

是的, 個工人有權留係香港14日, 但由於她是被解僱而不是完約, 就算香港真係有僱主請佢, 佢都一定要回菲律賓, 所以佢一定會用你張機票的.
另外想提提你, 一般open ticket是貴過普通機票的, 下次你訂機票比工人, 你最好與agent協議, 唔好劃死日期, d工人自己識得點去agent公司劃日字的.

She need to exit HK (she can stay in China or Macau to wait for her new visa instead of go back to Philippines)even she find the new employer. Normally she only have 14 days visitor visa to stay in HK BUT she can go to Immigration to request stay longer it's depends on Immigration approve or not.

Ticket refund is due to your credit card special offer to card holder, your maid will not know and she has no right to ask for another ticket from you if she give up the right not to use the ticket within the valid date.

Sorry I really don't know, but you can ask your maid to call Philippines Consulate 'OWWA' dept. to check the information for her.

最好裝攝錄機錄影佢，再唔係就設局裝佢再報警。捉到又入左罪抄佢當然唔駛賠一個月通知金，但唔入罪就有可能要賠喇。

我是從未請過工人的, 現在將要請工人來照顧小朋友,清潔,煮反...etc. 有个朋友介紹个agent 俾我, 佢話有个現成印印可給我見, 還可以試工tim. (據agent話這印印有凑b經驗, 清潔ok,識好少廣東話, 之前在馬來西亞做過, 現在在hk只做了半年, hk僱主炒她,是因為溝通不到)

1/ 請問我見工人時有冇咩特別要問她, 点樣test佢, 因我冇經驗,請提点? 謝謝

2/ 个agent 仲可以帶印印來我家附近睇办, 我都想問, 乜可以不在公司見嗎?

3/ 試工-- 是否需要付$ or 免費?

4/ 其實工人是被炒的, 對我這些從未請過工人的是否不太好?我是否應請d海外的工人会比較好?

Terrible Maid

Hi Rose,

My bun bun is terrible. She accused us for many things (which is NOT REAL) and complained to the consulate. We donno what to do and the agent said that if we fire the maid now, we will deem to be bad employer and will not allow us to hire the next maid. Can you kindly pm me and talk? Thank you so much.

Hi Mrs Rose,

My maid tonite give me resignation letter after i talked to her, she have to take care my 10mths baby & bring 3 small doggie go out for a walk 3 times per day, but home duties & baby have my mum in assistance. She always show "Black Face" & complain to my mum told a lot of work have to do, nearby have no shop for eating & shopping, mainly tonite my mum told me she beat my doggie & scored my mum that's why i talked to her & she make her own decision.

I would like to know below issue, pls help!

1) She write the resign by her handwriting & effective one month later, anything i have to beware of? Did i need to prepare another resignation acknowledge to her & both parties sign?

2) She only worked for 1yr 3mths around, contract not finished, anything penalty have to claim from my/her side?

3) On last working day, how many official public holidays payment i have to give her? How to calculate?

4) She will find job in HK again, did i have to pay for a one way ticket payment to her? If yes, base on which airline price?

5) I give her salary by cash with signed official receipt, will it be an excuse for her to sue me?

6) If before the termination date i want to early dismiss, what can i do?

7) Do u have any recommend agent/maid can introduce urgently?

Very urgent ! 如果我今天(21/2) 炒工人(比1個月通知佢做到下個月20/3), 但佢仲有2weeks大假未放(since contract end Apr). 我可以叫佢再提早走嗎 (eg. 6/3)? 如佢未完約是否 pro-rata 計14 days leave ? For one way ticket, 我應買幾日期比佢 ? 同埋我今曰要通知入境署嗎 ?

If the maid give a date and signed. Can she change her mind after? How much difference is a 14 days open ticket comparing with a fix date ticket say for example going to Manila?
