ANS: No need for acknowledgement or reply to her. Just keep the original for yourself.

2) She only worked for 1yr 3mths around, contract not finished, anything penalty have to claim from my/her side?

ANS: No penalty.

3) On last working day, how many official public holidays payment i have to give her? How to calculate?

ANS: Do you mean annual leave or statutory holiday?

4) She will find job in HK again, did i have to pay for a one way ticket payment to her? If yes, base on which airline price?

ANS: You have to pay for her transportation fee back to her place of origin (HK to Philippines air ticket and if necessary domestic air-ticket/ferry/bus/train fare). You can purchase the ticket yourself but ensure that the ticket is valid for at least 14 days after her last day of employment with you AND no need to pay penalty to airline if change flight date.

5) I give her salary by cash with signed official receipt, will it be an excuse for her to sue me?

ANS: As long as you pay her fully according to the regulation and contract.

6) If before the termination date i want to early dismiss, what can i do?

ANS: You can let her leave earlier but you still need to pay her until the last day of her notice.

7) Do u have any recommend agent/maid can introduce urgently?

ANS: No I don't.

想請問工人快完約, 但我要佢比完約前早走, 所以要一個月通知, 但只是口頭通知, 無簽任何文件, 會唔會到時工人話無收到通知而要我比一個月人工呢 ?

一個月前通知 : 21-FEB-08 (昨晚)

一般完約妹都唔會話無收到通知既，擔心既話咪叫佢簽收通知。
"You will finish your contract on March 20, 2008"

bun bun 大左肚

Dear mrs Rose, please help me as I have a really bad
situation!

We just found out from last night that our NEW HIRE bun
bun was 3 months pregnant -- we found out only because she got bleeding last night and we sent her to the
hospital. The baby now is safe in her body.

She signed contract in late October 07, and
started working in late December 07 (because her passport expire soon and we want her to renew passport before
she starts).

The situation:
(1) In the documents (immigration / application) she said
she is single, but she told us last night that she is actually married
(2) Her health check was done in early November, 07 and
showed that she was not pregnant. From the calculation,
she seems to get pregnant after the health check.

My questions:
(1a) How can we check her "real" marital status?
(1b) If she is really married, can we use this as evidence that she is "fraud or dishonesty in relation to her employment", and terminate her?
(2) It seems that she intentionally tries to get pregnant
after she do the health check. But is there a rule / law that
says the health check should be done XXX days before
the start date? The health check does not reflect the true
situation.

We really have no money to "yeung" a pregnant maid,
because I am pregnant (my second baby), I already
quit my job, and my home is small.

What can I do now? =(

hI Mrs Rose,

我細佬個case同newmommy 有類似情況:
1. 於Dec/07 尾已與該bunbun signed contract, 等visa出
2. 剛於上星期接到Immigration Depart. 通知, visa已出.
3. Agent昨天通知, 該bunbun 於body check 時不能通過, 因為發現佢pregnant.

Agent話philip果邊d body check時常有error, 所以建議再check一次. 但我細佬驚個bunbun來到hk後, 如果又過唔到body check, 咁邊個負責送果個bunbun走(回程機票)? 佢地問過個agent, 個agent話唔駛我細佬負責, 但張contract係我細佬做employer個喎, 咁係咪已經imply要employer 送個bunbun走呢?

佢弟婦佢下個月生啦, 所以而家好徬徨, 請指教~

~想問點計算呢7年,是否要完全唔離開hk?
我的印傭已經跟我們有7年,之前她再係hk做過2年!
她今年6月頭完約,我會同她續約的....
想問下,咁她可以攞HKID未?期間她每2年有放假返印尼!

~另外印傭續約是否一定要經agent?

~我見機票有分僱傭票(要持有效合約),不過比一般的貴,買機票是否一定買呢種?

MrsRose,
Can tell me what to do as my maid told me she has a part time job while her dayoff . She told me she sales some kind of "BioDisc" . Actually I don't know what is that but she really earned $$. I found her not good work at my family and told her not to do ... so what i still can do ? Warning letter ?? Anyway can protect employer in HK?

ANS:點計七年就要問入境處先知，其實以我所知外傭係唔容易申請做永久居民架。

~另外印傭續約是否一定要經agent?

ANS:要問印尼領事館先知可唔可以及點做，因為時時改政策。

ANS:唔係喎僱傭票應該係比一般的飛平至岩!

但工人3月中要回菲國兩星期, 我巳OK她, 來回機票已買.

Hi mrsrose,

what kind of food should be provided to Bun Bun if she is not eat with us sometimes? In the morning, if we don't have bread, what should she eat for breakfast, for lunch and dinner ?

Hi mrsrose,

My maid will finished contract on 30 Apr. I find a replacement which finish contract on 4 Apr. She agree not to go back home but start new contract with me. I have the following question

1. Can she stay in HK until start new contract with me on 1 May ?
2. I decide to do the contract not via agent. When should I submit documents to Phil consulate and HK immigration ? Pls advise the procedures/document I have to prepare.
3. There is a new procedure for Name/Direct hire effective on 1 Jan 08. Do I have to follow the requirement of it to hire the maid ? It require many docu like Cert of repatriation bond (USD5000), Cert of worker coverage under performance bond equivalent to Salary *3 mths. which is very complicated.
4. As I don't want a gap between my old and new maid come, can I request immigration to approve visa on 1 May ? If so, Is 1 May the contract start date ?
