Can tell me what to do as my maid told me she has a part time job while her dayoff . She told me she sales some kind of "BioDisc" . Actually I don't know what is that but she really earned $$. I found her not good work at my family and told her not to do ... so what i still can do ? Warning letter ?? Anyway can protect employer in HK?

It is an offence under the Immigration Ordinance for the maid to take up any employment with any person, even part time, other than her employer named in the visa. She will be liable to prosecution and removal for breaching the conditions of stay. If she is so removed, she will not normally be allowed to come to Hong Kong again to work as a helper.

It is hard for her to give up since you said she is really earning money from that part time. Moreover you are complaining about her bad performance. Therefore, you should seriously consider whether to continue employing her or not.

If you decide to give her a chance, you should ask her to write a letter to you to promise not to do the part time job ever again.

There are govt regulations to protect employer but you must learn to protect yourself first.

Most helper feel more comfortable eating alone in the kitchen instead of having it together with the employer. You can ask her directly if this is a concern to you.The maid can prepare her own food or reserve some portion of food prepared for the employer for herself. Or you can provide her with reasonable sum of money to buy the food for herself.

1. Can she stay in HK until start new contract with me on 1 May ?

AN: Yes she can.

2. I decide to do the contract not via agent. When should I submit documents to Phil consulate and HK immigration ? Pls advise the procedures/document I have to prepare.

ANS: You should start the application immediately your new maid finish her old employment contract. Start first with the Phil Consulate. You can approach the counter for Direct Hire and they will give you a list of instructions. Or you can check the Consulate website http://www.philcongen-hk.com/labor/main.htm

For procedure at HK Immigration, you can see the guideline and get the form here http://www.immd.gov.hk/ehtml/ID(E)969.htm

3. There is a new procedure for Name/Direct hire effective on 1 Jan 08. Do I have to follow the requirement of it to hire the maid ? It require many docu like Cert of repatriation bond (USD5000), Cert of worker coverage under performance bond equivalent to Salary *3 mths. which is very complicated.

ANS: This procedure had been suspended already.

4. As I don't want a gap between my old and new maid come, can I request immigration to approve visa on 1 May ? If so, Is 1 May the contract start date ?

ANS: You can request but the decision is with the Immigration. New visa can only be release after your old helper leave your house. I doubt you can get it on 1st May.

I still have many queries to resolve :

1. Since the new maid will finish contract in ex-employer in 31 Mar and I will start new contract with her in 1 May. Can she allow to stay in HK until start new contract with me for 2 yrs ? Did she need to leave HK before change employer ?

2. Who can go Phil Consultate for application of new maid ?

3. For HK Imm, do they allow overlapping of visa approval for each employer (old and new maid) as my maid's visa expire on 30 Apr but if they approve visa for new maid on 15 Apr, I want to check what's the start date of new maid contract ? Is it 15 Apr (Visa date) or 1 May (Stated in Green form 407) ?

I want to terminate the contract with my maid by the end of this month. What should I aware of since it is the first time I used maid.
Should I buy her ticket or give her enough money to buy the ticket herself?

Dear Mrsose,

我家菲姐3月中會提早放大假回菲律賓,放假後待11月份她已應承和我續第二張約,依次放假是當完約之14天年假,和她傾開計中,才知她在宿務機場還要座5小時的士才會到自己屋企,不過她又無和我提及叫我付的士費.....

所以我有幾個問題,如有空可否解答我:

1)除來回機票外,我還有否責任付.... 在家至HK機場來回巴士費?.....宿務機場至她家的的士費?
2)我還有否責任付...菲律賓機場出入境稅項,知道太約how much?
3)還有否其他費用,責任上需要我付的?

1. 我個菲傭係7月29日來我家, 今年7月會完約, 但Visa至7月25日, 完約日期即是幾多號呢?

2. 想再續約, 最早要幾時申請?

3. 菲傭想5月放假返家, 然後返嚟續約, 可以嗎? 若果可以有咩要注意?
4. 到7月續約時, 仲需唔需要比佢返家?

5. 菲傭話自己攪續約唔經agent, 我需唔需要親身去呢? 安全嗎?

6. 菲傭返港需唔需要再驗身?

My contract with my indo maid will end on 28th Mar and I've decided to renew contract with her. My mail will go back to Indonesia before starting our 2nd contract. So I've talked with my agent and PAID for all the processing fee, I also asked her to book the tickets for my maid.

I want to ask can I book the air ticket on 30th Mar? If yes, then where should my maid live on 29th and 30th? Can she stay in my home for these 2 days?

My agent told me that my maid MUST leave before 28th Mar, otherwise I may have to buy another VISA for her, is that ture?

你好! 本人o既菲傭將於4月回鄉5日(她未滿約, 這次vacation 同 ticket 係我主動俾佢獎勵佢o既工作表現), 現有問題想請教:

(1) 菲傭回鄉前, 有無需要打預防針, 如需要, 應打哪種? 費用由誰負責? 她家鄉在mindano (近general santos), 最近有無什麼登革熱之類o既傳染病發生?

(2) 我需事先通知入境處嗎?

(3) 我需要為菲傭額外購買旅遊保險嗎? 因她這次回鄉純粹探親性質, 如假期間, 或她返港途中生意外, 責任歸誰?

(4) 佢回港後, 我需唔需要帶佢去做多次check up呢?

(5) 為o左保障我方, 有無邊d文件我需要俾佢簽?

she can have her annual leave yearly, say 1st year>>7days or after contract, 2years>>14days??

幫工人買機票回菲律賓

你好，想請問我工人會於3月13日last day，我準備幫佢買機票回國，是否可以由我選擇買邊間airline俾佢搭?　如果我打算幫佢訂3月27日departure（14日限期內的最後一天），是否仍然需要買可改日期嗰種機票?係唔係唔可以買fix date機票?

ANS: The whole process will take around 3 weeks (including Philippines Consulate processing). The better timing is to start the processing 1 week after she leave her ex-employer place. She do not need to leave HK.

ANS: The maid can do all the processing herself at the Phil Consulate.

ANS: The visa can be overlap. The start date of new maid contract will be as per in the visa date in the passport.

Even if you not renew her contract she will still have 14 days of visitor visa to stay in Hong Kong. So why she MUST leave on 28th March?

Moreover, since you said you will renew her contract, she should have her new 2 years visa immediately at the end of her present one. There shouldn't be any issue at all.

Regarding release letter, this is part of the submission document as requested by Immigration. However, if the new maid only have it on 31 Mar and then we submit the application. Will the visa be approval before end Apr ?

Also, since I need the new maid 1 month after her ex-employer contract but you stated the better timing is start application 1 week after the maid leave her ex-employer place. Do you have any special reason/meaning on that ?

其實係個AGENT 開始的時候同我講話個工人28號完約, 咁就叫我俾佢放2個星期假返印尼, 新約就由佢回港個日開始計。所以就訂了30號機票去返尼, 4月13號返港, 14號開始第二張約。首先想問你呢個計劃有無問題 ?

第二, 但個AGNET 早2日突然打俾我話個工人唔可以30號走, 因為28號完約, 咁佢有2日真空期係無VISA的, 所以要27號走! 我都唔信個AGENT, 所以想問下你係咪真囉.. ?
