Finish Contract

Dear Mrs. Rose:

My maid's 2nd contract will expire on May6, 2008, I have some questions:

1. May6, 2008 is the visa expiry date, so is this the contract finish date if I want her to work until the last day?

2. She still has 6 annual leaves left, say if I want to release her early, then:

a. Is April 28 the earliest day I can release her by letting her taking these leaves?

b. So is April 28 the contract finish date? That means she will not be under my employment and employment insurance anymore? I want to protect myself against any insurance claims when she's not working for me.

c. And 1 month notice should be given to her on Mar 28?

d. Is the last day she can stay in HK 14 days after her finish contract date on April 28?

ANS:僱主要負責'車費'由機場去到工人家門口,但一定唔係要俾 "的士費"囉!叫佢搭旅遊大巴,又抵又安全又有收條俾返你claim。

2)我還有否責任付..菲律賓機場出入境稅項,知道太約how much?

ANS:僱主要負責香港及菲律賓出入境稅項,Manila就Peso750,至於宿務我就唔清楚,不過所有出入境稅項都有收據架,返黎先俾返佢。

3)還有否其他費用,責任上需要我付的?

ANS:Food & Travel Allowance HK$100 per day,來回2日即
合共HK$200 + 車費 + 出入境稅項。

(5) 為o左保障我方, 有無邊d文件我需要俾佢簽?

ANS: 無,但可叫佢寫封信confirm幾時返,過期唔返就當佢辭職,等你唔駛白等。

(6) 需唔需要佢回鄉前, 出糧(出到佢離港前o個日?) 俾佢?

ANS: 如果未到糧期就upto you,到糧期就當然一定要出啦。

ANS: Actually this only mean you need to let her vacation not less than 7 days, with pay or not depends how long she worked with you already.

2nd contract normally starting from the next day of the 1st contract expiry date.

2. The annual leave.
she can have her annual leave yearly, say 1st year>>7days or after contract, 2years>>14days??

ANS: Yes, 14 days withpay annual leave.

Present salary is HKD3480 per month. Any adults can be the witness.

ANS: Yes

ANS to a+b: To make it simple for you. You can let her leave on 28 April and just pay her salary up to 28th April PLUS 6 day annual leave by cash.

The earliest day the maid can leave your place and still consider as finish contract is maximum of 28 days before end of contract i.e. 10 April.

Her contract and insurance with you ends on the date she leave your place. Remember to submit your release letter to Immigration with the date stated when she left your house. You will not be held responsible for her anymore.

c. And 1 month notice should be given to her on Mar 28?

ANS: Finish contract don't need 1 month notice UNLESS you release her earlier. So for your case you can give her a early release notice.

d. Is the last day she can stay in HK 14 days after her finish contract date on April 28?

ANS: No, her visa ends on May 5 because she is finish contract and her visa date in her passport is on that date. However she can go to Immigration to extend her visa as a visitor herself.

工人於08年5月完約, 應跟她續約, 但不準備給予她回鄉, 她亦同意. 問題如下 ;

1.完約時, 是否只需補回大假及機票錢呢 ?
2.最遲要何時跟她辦理續約文件
3.她的護照於09年4月到期, 是否給假她換了護照才辦理新工作証明呢?若辦理新工作証後才換新護照的情序和收費會否增加呢 ?
4. 是否可轉其他僱傭中心辦理續約手續 ? (不跟聘請工人那間續, 行嗎 ?)

想請問一吓, 如果個工人比信我提早完約,而我請佢唔係經Agent. 咁我需唔需要通知入境處佢提早完contract?
我又需唔需要睇住佢出境?

Hi Mrs Rose:

I need your further advice here. I was confused by what the labour dept and immigration has told me about today. Here're the questions:

1. Immg told me I can early release her as you said. As I'm not sure how to calculate the salary, so I called Labout, but they insisted that there's no such thing as early release and no matter what I have to pay her until May6, 2008, except that my maid or myself to terminate the contract early. So according to the labour, the only possible scenario to have her leaving us on April 28 is that I pay her the 6 days notice in lieu of payment, plus pay the unused annual leaves.

Therefore, if:

a. I release her on April 28, 08 by paying salary upto April 28 plus 6 days annual leaves. Is this meant termination?

b. I release her on April 28, 09 but paying salary upto May6, 08. Then I don't need to pay her annual leaves, is this correct?

I told labout dept that what he said is contractory to immg, but he insisted this is the HK labour law.

A simple way to resolve your confusion is to give her a 1-month notice on 29th March and release her on 28th April. Pay her the salary until 28th April PLUS 6 days cash-in-lieufor her annual leave. That will take care of all your doubts.

我工人真係講極都唔聽話, 叫佢要清潔, 有禮貌...但多年都没改, 仲越來越過份, 請問我可唔可以出warning letter 比佢, list 晒我對佢既不滿, 如再重覆錯就即解僱! 佢可唔可以唔接受warning letter? warning letter 需要她簽收同意嗎? 如再犯錯, 是否不需補1個月通知金, 就可fire 那長期服務金又是否需給她? 謝!!

Dear MrsRose,

I really need yr help, as I was confused by my maid & agent. As her 1st contract will expire on 9May & we will renew another 2yrs. She need to go back Indo. from 18May
to 18Jun. So :

1) Should I renew her contract fm 10May, then let her go back from 18May to 18Jun but with no pay from 2Jun to18Jun (as we give her 14days AL)???

Or
2) Should I renew her contract fm 18Jun, then pay her 14days money & she go back to indo. fm 18May to 18Jun???

For passport, it said expire on 16 May 09 on the page w/ photo, but there's a stamp saying the permission stay is
to 9 May 08, so which date is correct ??

For option 2, will there be a problem for her visa ???
