hi mrs rose,

I decided to terminate the contract of my recent helper who has worked in my house for almost 6 months. Since I need someone to take care of my 2 yrs old girl during we go to work in the daytime, so I cannot just fire her now. I will sign another contract for applying the replacement from Indo today. I decided to fire the recent one after I know the exact coming date of the replaced helper. But I have few questions want to consult with you...

1. Do I need to pay the 2nd instalment of the Employees Retraining Levy for my recent helper which will be dued on next Monday?

2. Is it like a new application for the replacement, so that I have to pay the 1st instalment of the Levy for the new one when signing the new contract?

3. then, can I get the remaining balance of the recent one after she's fired OR transfer to the replacement account?

4. Can I just ask the recent helper to leave my house on the day that I pass her the termination letter and payment?

5. Should I buy her an open ticket or a fixed date ticket? I plan to buy her a ticket with the date of the day I terminate her, is it okay?

Thanks very much. My maid wants to work until April 30 only, Immigration said I should ask her to produce me a writte notice so that our contract will be terminated on April 30, instead of May6. I think this will be the best way to handle.

Dear Rose,

以下是個較長的故事, 請明燈指示.
我有一朋友很困擾,以家吾知點做,我朋友每星期有2-3日系大陸做野, 已有2子女. 今年二月佢老公向佢擔白他和前印尼工人有染（印尼工人是有老公和1個3歲子）, 同日舊印尼工人都打電話比我朋友交待佢在任時已同佢老公有染, 重系系主人張床搞野已有年多, 平時放假就到外開房, 合約到2007年4月底完兩人關係都繼續到以家，直至工人12月回印尼,而我朋友老公半夜打電話到工人家,驚動佢老公, 老公開始懷疑和吵架, 工人又吾想同佢老公離婚, 朋友老公又想維持完整家庭, 於是兩人就分手, 工人在電話同我朋友話佢一後吾會再揾朋友老公,並要求我朋友吾好離婚, 佢6月會回印尼 (佢同新顧主合約未完).
舊工人同我朋友以家新工人是相識, 呢件事爆出來後才發現原來舊工人離開後不斷都找新工人問長問短, 最衰我朋友老公物野都同舊工人講,甚至懷疑新工人偷錢/想抄佢都同舊工人講. 此事發生到以家只有半個月,以家舊工人就用短信騷擾, 系短信話新工人偷錢, 偷懶顧主會抄佢等…雖然舊工人話以後吾會揾朋友老公, 但以家都有揾, 我朋友自己已搬出來, 子女暫留夫家, 舊工人好似顛, 我朋友好擔心子女安全.
想問Rose我朋友是否要想舊工人現時agent講, 或有何方法阻止舊工人的行為.

ANS:需補回大假錢，至於機票你願意俾就俾，因法例其實無話唔放假機票要折現。

2.最遲要何時跟她辦理續約文件

ANS: 完約前1-2個月。
3.她的護照於09年4月到期, 是否給假她換了護照才辦理新工作証明呢?若辦理新工作証後才換新護照的情序和收費會否增加呢 ?

ANS: 就算唔回鄉都要出HK境，可以等到出境前先去RENEW passport都可以，出境時帶齊新、舊passport及合約，回港時會俾你Visa至2010年5月完約，visa免費。

4. 是否可轉其他僱傭中心辦理續約手續 ? (不跟聘請工人那間續, 行嗎 ?)

ANS: 可以轉其他僱傭中心辦理續約手續。

我工人真係講極都唔聽話, 叫佢要清潔, 有禮貌...但多年都没改, 仲越來越過份, 請問我可唔可以出warning letter 比佢, list 晒我對佢既不滿, 如再重覆錯就即解僱! 佢可唔可以唔接受warning letter? warning letter 需要她簽收同意嗎? 如再犯錯, 是否不需補1個月通知金, 就可fire 那長期服務金又是否需給她?

你當然可以出warning letter 比佢，亦可如再重覆錯就即解僱，但多數都要補一個月通知金，因法例其實從無話出左warning letter 就唔需補代通知金! 而長期服務金就一定要俾喇。

佢可以唔接受warning letter架，warning letter要佢簽收同意當然最好啦。

其實兩個方法都可以，我通常用"月薪/30天"比較簡單。

ANS: Yes, you have to pay the levy as long as you are still using a helper.

ANS 2 &3: After you had fire the present helper, the remaining balance will be on hold and you can transfer to the new replaced helper with you apply the replacement.

ANS: You can terminate her immediately provided you pay all her due compensation (salary for the month, 1 month notice in cash, outstanding leaves, transport and food allowance).

5. Should I buy her an open ticket or a fixed date ticket? I plan to buy her a ticket with the date of the day I terminate her, is it okay?

ANS: You should book her on an open ticket. Able to change the flight date without penalty.

最近收到財務的overdue letter，問了姐姐，她解釋為初來港的朋友借，借款額$18000，倘有4期，我姐姐到本年8月份完第一份約。她的工作普普通通，不太差也不大好，照顧我歲半囝囝倘可(出世至今)。如沒發生借款一事，相信會跟她續約。問題是她私自取去我們地址証明去借錢，當然我們担心是財務會騷擾我們(若她不還或再借)。是否解雇她為佳？有其他高見嗎？

請問DirectHire除左agent fee，係咪要比類似training fee菲律賓政府(如果工人第一次出國)，好似要成６仟幾，但係個agent無同我講，只係聽朋友話。

而家借錢唔需要僱主地址証明，只要出示佢自己任何信件都可以，唔駛 "私自取去" 即偷你們的地址証明。解僱佢無問題，但問題係下一個新請既工人亦可能會借貸，咁點?到時又炒。其實借錢本自無問題，我地用信用咭、供車、供樓、稅貸...全部都係借貸，只要有借有還無問題架。所以要同你工人講清楚，以後確保要準時供款，最好出糧時即刻捉佢去入數，咁財務就唔會騷擾你地啦。
