妳好啊!我想急問一下.......
我發現我工人沒有照顧好BB,不餵飽佢.還打鬧Baby兼偷錢!!
我可否即炒不補一個月通知金給她呢?
機票是不是一定要買??
還有一百元的車資????

家中沒有其他人
亦沒有其他親戚朋友可以幫手

ask her to resign or give her one month notice ?

Dear Mrs Rose,

I want to terminate the contract with my maid, should I ask her to resign or give her one month notice ? which one is better for employer ?
I empoly her from Feb 10, 2007, if new maid come on May 17, 2008 and this time my husband will be her employer not me, will gov't return the balance of levy to me or how to handle the balance ? Thanks for your kind help !

Hi Rose,

If I want to extend my present maid for further 1 month once shecomplete her 2-year contract with me, what and how to proceed theapplication? Do we need to apply in person?

Hi, Rose,

I 'm so plazzle that I have received a letter from the Labour Reltaions Division that my ex-maid claim me for
1) wages in arrears
2) statutory holiday pay
3) others

She early terminate her contact by her decision on Mar 22, I already issue an air-ticket for her & she is supposed to leave HK on Mar 29.

I want to know,
1) she logdged a claim to me, is that means she is still in HK?
2) I have kept all the wages receipts & holiday receipt, shall I bring these to the conciliation meeting?
3) how I can win the case?

The conciliation meeting date is Apr15, 2008.

Thanks in advance & I'm looking forwards to hearing from you.

May I know what it is? My new employed local Philippino helper paid and said that it was a new policy to join and I have to pay nearly $200 for her.
Any advice?

各位,

我工人原本係下個月中完約, 起初我打算等佢做到
last day, 果兩星期大假就補番錢比佢, 點知前晚我
個女話比我知,話姐姐同佢講因為有左BB成日見肚痛,
但工人到依家都無直接同我講佢有左,
佢突然放風話有左BB, 我唔排除佢因為想早D走
而特登作野話比我個女知, 等阿女話番比我知,
若我怕惹麻煩而比佢早D走, 咁佢就得米,
雖然唔知佢大肚呢單野係真係假, 我唔敢博,
若萬一佢真係有左而個肚有乜依郁我都會好麻煩。

我想知呢個 case 我應點做？佢下個月就完約，
若佢真係同我講有左或有醫生紙証明，咁我須要
做乜野呢？係咪完左約就同我再無瓜葛？

我諗住放埋呢兩星期大假叫佢五月頭走有冇問題呢？

Mrsrose,

My maid will finished contract and left my place on 30 Apr. She now find a new employer and her agent want me to sign a termination letter which state that the maid will left my place on 30 Apr. Should I sign and give her for processing of new contract now or just give her or immirgration directly on last day of her leave ?

Usually will give on the last working day, give her now or not is upto you, no need to listen to her agent.

根據法例完約後就唔關你事，不如你盡快通知佢，5月初會提早俾佢完約，等佢唔駛咁多小動多。至於有BB既事千其唔好問，佢唔親自同你講你就一於當唔知。

Actually this is not a new policy, this is one of the protection programs from the Philippines Labour Department for all the overseas worker welfare, according to HK Laws employer have to pay for it.

你可以打封信去入境處要求black list個衰工人，但black唔black list佢就要由入境處決定，僱主無話事權架。

工人名、ID number、passport number, reference number如有。Details就當然係越details越好，用中文/英文一五一十寫清楚，所有事情即可。

1. Of course she still in Hong Kong and she will stay until the case settle.

2. Yes, all the papars (receipts & warning letters if have)
about your maid you should bring to show to the Labour officer.

3. If you never did what your maid complaints, you will sure win.

Either you or your maid need to apply in person and you need to prepare a explaination letter about why you need to extend one month visa. Bring along the letter together with original passport & 2 sets of origianl green contracts
pay $160 for the visa, you will get the visa within 2 hours.

勞工假不可以$代替，只可以改期放。

You want to terminate her of course you should give her one month notice, BTW I don't thing she will agree to resign. If you want to transfer the Balance of Levy, employer name must be the same, that is the regulation from HK goverment.
