mrsrose,

我是第一次請工人的, 所有手續已辨好, Immigration已批ｖｉｓａ，　但是工人來之前有意外，　現在不能來．　我以下的問題：

１．已付Immigration的稅是否可退回？
２．如果在一段時間內沒有合適的工人，　因急需工人，　可能找另外一間雇傭公司，雇傭公司那一方面，要有什麼補賞？
３．是否有一些完成合約的工人，　不需要出境，　就可以直接來工做呢？

Hi, Mrs. Rose,

Sorry to bother u again.
My maid have been provide all the document
to HK immigaration & Phil. Consulate on Apr 02, 08

For Phil. Consulate - she can get the confirmation
(or employment contract) by Apr 09.

For HK Immigration - have her to go back on Apr 22
and to prepare $160 visa fee & levy payment. and also
remind her cannot leave HK during this period until Apr 22

Pls adv.
(1) My maid said that she don't need to go back to Phil.
before she start work with me as she may get
a 1 year visa upon Apr 22, 08. Is it?

(2) Start working date - pls adv if the earlier date
we can let her to work is Apr 23, 08.

She need to exit Hong Kong within one year, either back to Philippines for vacation or go to China/Macau, when she return to Hong Kong Immigration officer will give her the visa until finished contr ...

You should pay upto Seremang ticket fare. About the travelling allowance we normally pay HK$100 per day from HK to Seremang, plus HK$50 as for travelling from Seremang airport to her house, total HK$150 per trip.

在接工人當日 (2 號), 面對面問agent, 佢都話2 號開始計, 而 agent 又直接同工人講, 話因為佢2 號才開工, 所以計薪水是由2 號開始計, 個工人都話無問題.

但我係唔係應該唔好慳個佰多元, 避免個工人反面時, 告我呢?

正確! 其實工人真係1號去上班，只是路途遙遠及到步後又有好多手續要辦(佢係因公事)未能即日上班，要2號先到你屋企咁解。當然係1號起計。

1. Levy可以全數退落下一個申請。

2. 你當然可找另外一間僱傭公司，至於有咩補賞俾你就要問返Agent先知喇。

3. 在港完約工人，可以在港轉僱主，新簽証出後就可以同你做工，不需要立即出境，只需一年內出一次香港境即可。

I do not endorse or comment on any agency.
Besides considering the agency charges, you should compare the service content from different agencies too. My 2 cents worth of advice is to look for experience agent who PERSONALLY conduct the selection and interview of the applicants. Do not be afraid to ask any question that you have, that way you can also test the service quality.

Immediate termination without 1 month notice in advance have to give 1 month salary in lieu by notice. If you will employed another maid to replace her, no need to pay her "遣散費" .

You can either contact you agent to help you to settle this or if she really file a case at the labour department, you can settle this with her during the labour department meeting.

Ans:
(1) Yes.
(2) She can only start working for you legally once she get her visa from the HK Immigration.

雖然我唔知入境處會唔會black list佢, 但我都應該做我本份話比入境處知

你可以打封信去入境處要求black list個衰工人，但black唔black list佢就要由入境處決定，僱主無話事權架。

工人名、ID number、passport number, reference number如有。Details就當然係越details越好，用中文/英文一五 ...

工人來了個多月,因家庭經濟問題不可再僱用,如果有朋友想take over 佢,有以下問題請解答:
1. 佢是否需要返philipino再來港,即我是否要給佢來回機票?
2.佢地可否自行set contract,或一定需要經agent?
3.因工人來港已借下債for agent fee,有什麼方法工人可無須再比agent fee 而take up 新合約? (因佢大致表現良好,我唔想因個人問題而害了他人)

Thank you for your advices. I will try to ask more questions on Sat. After seeing all these negative comments involving so many agencies. I am really scare. Cos' the first Indo lady that we hired for 5 years ended up stealing and she herself worked as a loan shark in our estate. It was disappointing and I was not the one that found out. My mom did when she came back to HK for vacation. Cos' me and my hubby are both working parents. The first agency was introduced by one of my mom's friends. Talking about the whole thing once again, it still hurts as we treated her like family. Everytime when she finished her contract, we let her went home for 4 weeks, as paid leaves. As we felt that she was being away from home for such a long time, so for the past two contracts, we allowed her to take four weeks off. How stupid thinking about all these again. I am just hoping that I could at least find a reasonable person, trust worth to look after my boy. Thank you again and sorry for the bull. Have a great day!!

印印不想返回她agent, what can I do?

Hi Mrs. Rose,

印印工人來了3個多月後, 因現在婆婆ok可照顧BB問題,不再需要僱用印印,
她是本地滿約工人完約on Dec 07, and 印印已經返回印尼3 個星期, Dec 31, 07號才到我家:(因
想好來好去,有以下問題請...).

A - 如果印印no more new job and I just want to give her 一個月通知, but 印印不想返回她agent, what can I do?
Q1. 即我是否要給佢來回機票? Or one way ticket ok? How long the ticket shall I buy? (The ticket 2 weeks? Or one month? Or ???)
Q2. 如果我今後不使用外傭, 已經繳付Levy可否全數退回?
Q3. 印印Dec 29 號已到港, 要 Dec 31 號才到我家, 但我發現了 Levy “Date of Issue” is Dec 6, 2007 and next instalment due date is Jun 6, 2008, 如果我給她一個月通知, 是否 May 5 on or before?

B - 如果印印have new job再港轉僱主,:

Q4. 佢是否需要返印印再來港,即我是否要給佢來回機票? Or one way ticket ok? How long the ticket shall I buy? (The ticket 2 weeks? Or one month? Or ???)

C - 如果印印選擇自己辭職,
Q5, 她給我”英文”辭職信件? Or ” 印文”辭職信件? 問請 any template? (she claimed that she don’t know English but I don’t know印文, how come?)

I employ the maid which was released due to employer's financial problem. The immigration will interview her on 23Apr. Do you know when will her visa be issued ? Can I send 加快信 to immigration now to request for earlier interview ?
