I want to terminate the contract with my domestic helper (work for me around 1 year) by giving her 1-month payment in lieu of notice, salary, annual leave payment, travelling allowance ($100) and one single ticket to Manila.

Questions:
1. Is that all I have to give her?
2. What kind of air-ticket should I buy?
3. I am not satisfy with her performance so I terminate her. How should I write the termination letter? Can you give me a sample?
4. If she asks me to give her a reference letter to find employer in HK, what should I write so that it will not bring me trouble afterwards?

My relative would like to direct hire a Filipino as a DH, the agent said the normal practice is to share the cost with the maid, that means if the employer pays $4000 to the agent, then the maid should bear the cost half ($2000) later. I would like to know if it is legal?

Moreover, I would like to ask the estimated expenses on the followings:

1) Mandatory Insurance (Is this insurance which should be issued in HK after she comes?)
2) Medical Examination Fee (Done in Philippines?)
3) Notarization Fee
4) Visa Fee
5) POEA
6) Others (any others that employer needs to pay?)

Questions:

The items to pay her is correct. The flight destination and travelling allowance must be to her place of origin. You can check the employment contract to see the destination.

2. What kind of air-ticket should I buy?
You can ask your travel agent for domestic helper ticket. The ticket must be open and valid for change of flight date within 14 days and without penalty for date change.

3. I am not satisfy with her performance so I terminate her. How should I write the termination letter? Can you give me a sample?
You can modify from this Click and add in your reason or not.

4. If she asks me to give her a reference letter to find employer in HK, what should I write so that it will not bring me trouble afterwards?
You can just give her a release letter without stating the reason. The content just state she had work for you from when till when. If she ask, just tell her that without stating the reason is for her own good if she want to find future employer with the letter. Anyway, it is not mandatory for employer to give release letter to the maid.

妳好！我係第1次請工人，現有問題如下︰
1. 印傭第1次嚟香港工作，agent話佢頭半年係無假放，係未真？
2. 半年後，1個月只需放2日假比印傭(因agent話同印傭簽約時已經講明1個月只有2日假)，咁有無犯法？
3. agent話佢簽印傭時已講明嚟到香港唔會放勞工假，只放印尼假，又有無犯法？
4. 我同agent簽約時已寫明印傭需要照顧埋我父母屋企，咁若我去咗旅行，佢可唔可以帶埋BB去我父母家住及幫我媽媽煮飯？

因agent係印尼自己有學校訓練印傭，所以同印傭有以上協議，我係未可以跟隨而唔犯法呢？

My maid already worked for 1 year and she would like to take 7 days leave in advance. I read some of the post that I need to prepare a letter to Immigration such that she can re-enter HK. Do I need to send this letter to Immigration Dept? Or I simply give this letter to my maid and she present this during the re-entry?

No need any letter, she can in/out HK at anytime as long as her working visa still valid.

有野想問, 煩請幫忙, 謝謝.

1) 工人剛去入境處申請了多兩個月visa, 到8月底完約, 會同她繼續, 請問應幾時去攪手續.

2) 因會叫賓姐自己去攪, 到時有咩文件要比她, 同可被免她睇到自己私人野, 費用又如何, 同時間, 共要去多少次, 係咪要閒日比她去做野.

3) 她揀10月底11月頭才回來, 機票到時貴唔貴, 同係咪共放16天.

4) 同以你經驗點可保障我地僱主, 她回來我家時, 可免有什麼問題發生.

Hi Mrs Rose,

The contract (2 years) of my maid will be expired in Sept 2008. She said she may not renew the contract. I asked her to reply me in Jun 08 for me to find another maid. Can I release her earlier with one month notice. Also, do you know where can I buy the cheapest ticket for her.

謝謝妳的回覆，咁我想問我係未可以唔跟agent嘅見議，照放印傭一星期一日假？但agent已同印傭講好放印尼假，若我放佢勞工假再放埋印尼假咁佢未放好多假？咁可以點？同埋我印傭6月先嚟，但我6月要去5日旅行，我十分唔放心比佢單獨係我屋企照顧bb，若我叫印傭去我媽家瞓但唔洗佢做家務又得唔得呢？同埋若我媽想佢做家務，比番錢印傭又得唔得呢？

我的印傭來了20天, 但她成日犯錯, 今天晚飯時,她把其中一把刀整斷了, 一小塊刀片碎混左入d"送"度, 我老公食到塊刀片先知佢原來整斷左把刀,差d入醫院,所以我都怕比佢揍bb會有問題, 仲要係問佢先肯講真話,

何時向工人提出唔續約?

工人第一個約到2009年1月9日完約, 由於兒子返幼稚園, 不需要用工人, 請問 :
1. 向工人提出唔續約(需要多少個月提出?), 唔續約擔唔擔心工人玩野, 有何提防方法?

2. 請問2009年1月9日完約, 扣除14日大假, last day是邊一日?

3. 工人是同事完約後不用轉比我用, 工人沒有回菲律賓, bunbun 自行搞申請, 請問我需要比來回機票錢, 還是比單程?

4. 完約後最後一日才出糧和機票錢比工人, 可以嗎?
