Hi Mrs. Rose,

Thanks for the advice. We have been all along staying away from her own finanical problem. This is the first time the lender gets in touch with us directly with a lawyer letter.

We are worry that if a Garnishee order is really served against us (the employer), we would be forced to pay her full salary (plus potentially the long service payment) to the lender. Under such situation, it is difficult to predict how our maid might react. Would she really work as normal if she are not going to get any further payment? Have you ever heard of any case that the lender really apply for a Garnishee order against the employer?

My advice is not to be involve or response in any loan matter for the domestic helper. Do not commit anything. Let your maid sort out the loan matter herself.

video camera

My friend install video camera in everycorner of her house, even the maid's room and bathroom. (The maid is not sharing room with anyone). I just wonder is it violate to the law cause it is something related to "privacy"?
Since the employers are lawyers, the maid dare not voice out this issue...especially video camera in the bathroom. Can she seek for help?

Would it be my maid's responsiblity to apply for her visa once she renewed her passport or do I have to do it on her behalf? What happens if she renews her passport but fails to apply for her visa extension and returns to Philippines for her vacation, will she be able to return to HK ?

Hi Mrs Rose,
請幫助我的問題

我舊工人約滿, 但在hk已找到新僱主,agent叫我比$1800當係機票錢, 我唔想比錢個舊工人, 所以仍買了機票給她, 係non-refund, (甘就唔可以退票攞錢), 但e+個agent 就叫我要求旅館退票, 比返d錢個舊工人, 仲話個工人e+唔走, 張機票用唔著, 會浪費左, 如果第日佢要走, 有權要我再比一張機票佢, 又話總之佢要走的話, 就有權要追究番個張機票, 講到尾都係叫我比返d錢個工人

1. 其實我都唔想退票, 二千幾我已比左就算, 只想做番我的責任, 但係米將來佢真的有權要我再比機票呢 ?

2. 如果我退左張票, 一定唔會比返d錢個舊工人, 係米等佢再要機票至算呢 ?

我覺得好似係個agent要d錢, 多過係個舊工人要甘 ? 我兩個都唔想比, 最多益左航空公司, 但如果等日佢要我再比機票佢, 甘我米要比兩張 ? 4000+?

我應點做呢

So far I have not come across any employer who responded to such letter from their maid's finance company. You will not be liable to deal with the finance company as long as you didn't consent to it.

If the maid have to work for nothing because her salary will all go to pay the loan, she will definitely resign or runaway.

I am not a lawyer but I do believe it is a violation of privacy especially if the camera is installed in privacy location like bathroom and bedroom. The maid do have her rights too. She can approach the police or her Consulate for help.

It is also employer's responsibility to employ the maid legally. Her visa is linked to her old passport. Therefore when she renewed her passport, she will have to apply for new visa to be placed in her new passport else she will not have her visa record when she re-enter Hong Kong in her new passport.

賠償及warning letter

Dear Mrs Rose,

本人第一次請菲傭，有問題如下：

1. 工人打破了廚房的Corian sink盤，因維修費需要$5000元，我是否只可以扣她$300？

2. 若已扣$300，是否可同時給她warning letter?

3. 查看過天書內的warning letter, 好似不太合用。但本人不懂得如何編寫，請問有沒有其他sample供參考。（英文版本）

只要你張飛有14日或以上既有效期而又可免費改期既話，就唔駛理佢地，告唔入既請放心。

ANS:Yes, 每樣$300及只可扣一次。

想請問我將會用經濟理由唔用工人,工人可唔可以自己搞新合約,而唔經AGENT架,如可以咁手續係點呢,謝謝
