Below are some articles on the continuing game of ping pong on the issue of China and the safeguard actions. Since last Friday’s note, the EU has now moved forward on requesting consultations on safeguards for two categories, joining the US, which earlier in the week had formally requested consultations on 7 categories.

The Chinese responded by announcing cancellation of both the original export tariffs as well as the increased exports tariffs for a number of those same textile and apparel categories. At the very bottom of this email is a blurb and links two lists that Nate fished off of the Hong Kong government web site. Those links identify the categories no longer subject to the export tariff and those that are still subject to the tariff beginning June 1 – for now.

The Chinese are also raising the possibility that they will challenge this in the WTO – although given that that process takes some time to work through that path is fraught with as much uncertainty as where we are now.

Commerce Secretary Gutierrez and other Commerce officials, including Textile and Apparel Deputy Assistant Secretary Jim Leonard, are in China this week to begin discussions on this issue (the US and China have to consult within 30 days after the formal request for consultations). Not sure when or how the Europeans will do their consultations. Consultations on this issue could result in no change to the existing quotas that were announced last week. Or it could lead to discussions that could result in some sort of negotiated settlement that may adjust the quota amounts or time period.

Still to be determined are whether the USG and Europeans will request consultations on a host of other pending categories, such as bras, wool trousers, dressing gowns/robes, and sweaters. The WSJ article this morning (and excerpted below) has a chart that shows what is still outstanding. No word yet on what new petitions may be filed in the coming weeks.

Separately, but obviously related, the Administration rejected a lawmakers’ petition on currency issues. However, the Administration continues to talk tough on this and other issues, including intellectual property rights.

All of this is perhaps best summed up by Willy Lin of the Hong Kong Textile Council who observed that sourcing in China for the next few months or years will be “a total mess.”
