Hi all MOM:

My Flipino maid will have her contract expired in Mid September this year. For the past few months, her work performance and especially her attitude has dropped so much which gets to a point that is totally unacceptable (actually quite MAD and seriously, our expectation for the maid is just normal housework , cooking + taking care of my 2 years old daughter.)

As a result, due to her performance , we have already hired a new maid which will be with us by the end of July and we will fire the current one about that time.

There are a number of questions that I want to hear from some experience MOM which may be able to give us some suggestions / recommendations on how to handle it.

1) The time when we fire the maid, should we stated:

a) Due to her performance issue, we have decided to terminate her contract and give her whatever we need to pay her by the labour law. If we choose this, do we need to give her the warning letters before hand if we take this approach?.. or

b) a more Melo tone with an excuse on things such as "Financial issue...etc" which bascially pay her to leave.

2) If we fire her 2 months before her contract end, will this be considered as "TERMINATION" or "CONTRACT END"? Any effects as if she wants to find a new employeer?

3) We are thinking to proceed this way on that date:

a) Take my daughter to my parents house
b) Notify the managemnt office and ask them to send someone as the witness for the entire process.
c) Tell her to stop her work
d) Notify her the situation and stated that we will take her back to the agent and will talke more afterwards.
e) Give her about 30 - 45 mins to pack up all her belongings and let her know that she will not allow to come back to the house after as if she did not pack all her belongings at this time.
e) Insepct her luggage in front of the witness to ensure that she only takes all her stuffs only.
f) Take her back to the agent and will work out the total amount that I need to pay her base on the HKSAR labor law.

Can someone see any problem with this approcah and anything that we may did wrong which will cause us some follow up issue later on. Greatly appreciated for any suggestion and recommendations.

炒佢當日只需要同佢講因為你既表現, 令到太太無辦法同你finish contract

斷約....你炒得佢就唔應該幫佢考慮佢日後揾工, 最好等個新僱主打黎問佢工作表現, 數佢

其實你呢個安排都ok架啦, 最重要係錢銀姐, 你炒佢, 佢可能會好開心添, 又執多個月, 你就肉痛d, 無啦啦要蝕多個月.....但我諗佢真係好難頂先要你行呢一步架姐, anyway, good luck.

如果我真係好憎佢, 我會去到 agent 度, 一邊錄影一邊 check 佢行李. 原因係:

1) check 完行李佢都未行出您門口, 仲有機會比佢順手hin羊偷您的野.

2) 去到 agent 度先check, 如果發現屋企的野, 我會報警. 因為已經出左您門口, 證據確"作" 係"偷".

Make sure to use the camera to take movie.i.e. 影低過程. Otherwise, she may hurt herself and claim you hurt her. Remember to pay in crossed cheque in favour of the maid
