Hi everyone - Please read this! You don't have to pay any air ticket or ticket fee to your helper if she finished the contract & renews one with you since COVID 19 last year. You have to pay her the 14 days AL, THAT IS!. I checked with the lawyer today because I got the same issue with my helper, I terminated her last week & she immediately "THREAT" I said I need to pay her over $5000 air ticket because the labor department told her. I was thinking of giving her $2500, but she insisted that she needs $5000. I asked her to go to the labor department to file.
Here is our employment contract - #7: all employer needs to respond their TRAVEL expenses for "Termination" or "Finished Contract".
Termination - of course, you need to pay her ticket - no need to explain
Finished Contract
1. after finished the contract, if she keeps renewing the contract with you, she has to go back to her home town renew her visa. Therefore we need to pay her "Travel" expense, REMEMBER! is for her to renew her visa at her home town, not for her to go HOME.
Since COVID last year, due to the lockdown, HK immigration release the rule - all finished contract helper if they renew the contract with the same employer, they don't have to go back to her hometown to get the visa, they can get it in HK. SO!!!!! WHY do we need to pay her the ticket? Understand now? My lawyer told me many people were confused that PLEASE check with your lawyer friend if you have. You don't have to pay them any "ticket" fee. since last year till now due to the COVID.
If any helper breaks the contract or is terminated by the employer now without finished the contract year, HK immigration may not release any working visa. Only a finished contract helper can get a new job in HK now.
Please, please, please check & don't lose any money on those big liar helpers!
7. (a) The Employer shall provide the Helper with free passage from his/her* place of origin to Hong Kong and on termination or expiry of this contract, free return passage to his/her* place of origin.
(b) A daily food and travelling allowance of HK$100 per day shall be paid to the Helper from the date of his/her* departure from his/her* place of origin until the date of his/her* arrival at Hong Kong if the travelling is by the most direct route. The same payment shall be made when the Helper returns to his/her* place of origin upon expiry or termination of this contract.
