I got fired by my company after I told them I'm pregnant, I'm still fighting with them right now through Labour Department.
I also went to 平機會, they ask me what was the reason the company fired me if it is not pregnancy related, there might not be a case. Come on, what company would say "I fired you because you are pregnant." or "I fired you because you lost a leg." HK 平機會 is very useless.
Also for those that are pregnant, don't believe the movie that you are untouchable, that companies won't fire you. Because even if they fire you, the company doesn't really have to pay you that much (by law). Like my company although I'm fighting through Labour Department, I'm still only getting very little and the Labour Dept is not necessarily on the pregnant woman's side.
of course no boss will be so stupid to say that I am firing you coz you're pregnant. However, they must give a "reason" of terminating you. If you are good employee that work hard & smart (I assume that's the case), they have no strong reason to support their point of termination. Then, you can use that point to support your agruement that they fired you coz you are pregant.
I am working in US funded company, I know the culture of US companies is that the top management won't want to engaged into any illlegal affairs and would avoid any law cases. So, they will at least pay you what you should have. By going to 平機會, I mean to ask for the right to have the boss to say SORRY.
Even in US, the boss still discriminate you ga. Although I work at Japan company in US and my boss is American, they just don't like the employee being pregnant and eventually disappear from the workplace for couple months. Last time, my boss told my coworker that "how can she be promoted when she got pregnant". Although we can complain to HR, but no one want to get into trouble especially economny is not good ar ma!
You better record down when your boss said that to which co-worker. If anything ever happen to you and you need to go to "Equal Opportunity commission" that would be your evidence. Very important.
Right now I'm going through Labour Department to get what I deserve. They didn't give me a reason why they fired me (not in the termination letter nor when they spoke to me) at the Labour Department meeting, they said "Not suitable anymore" which was a lie. Anyhow, we are going through out of court settlement. I will be getting money from the company but all I'm saying is that this is not US or Europe or Australia (I have reserached other places' court cases) even if the case is on my side, I won't get much money. In US, just punitive damage can go up to USD100,000 even for factory workers.
My ex-boss also said the company won't issue an official "apology" letter.
