Before you came back, did you sever all your residential ties? Eg. cancel your driver\'s licence, health card, Credit cards, bank accounts etc and sell your house?
My understanding is as long as you can proof you severed all residential ties before u came back to hong kong, you should be ok. But if not, then they can deem you were not a non resident for income tax purposes.
Whether you file a non resident form now will not make a difference. In fact, you may be better off not alerting them of your current status.
But I also want to say that if you have not paid taxes in Canada all these years and want to go back to enjoy Canadian healthcare later on, it is unfair to those of us that have worked and paid our fair share of taxes.

Well then. Probably not a good idea to alert them now and claim non resident now because you kept your residential ties all these years and they could deem u were a resident for tax purposes and tax u.
I guess the best way is to find an accountant in Canada. which part did you live in the past? If you are in Vancouver, there's an accountant at parker place that could help claiming for non-residence status.
