AUSTRALIAN CITIZENSHIP ACT 2007 - SECT 12

Citizenship by birth
(1) A person born in Australia is an Australian citizen if and only if:

(a) a parent of the person is an Australian citizen, or a permanent resident, at the time the person is born; or

(b) the person is ordinarily resident in Australia throughout the period of 10 years beginning on the day the person is born.

Enemy occupation

(2) However, a person is not an Australian citizen under this section if, at the time the person is born:

(a) a parent of the person is an enemy alien; and

(b) the place of the birth is under occupation by the enemy;

unless, at that time, the other parent of the person:

(c) is an Australian citizen or a permanent resident; and

(d) is not an enemy alien.

So unless one parent is a PR (which the child gets PR)

or

the child lives in Australia for 10 years (has to be a resident within Australia) which the child will grant citizenship automatically

佢好明顯係吹水，澳洲行屬人法，子女出生父母雙方必需有一個有 PR ／ CITIZENSHIP 個細路先會有澳洲身份，否則你可以拎到既只會係一張澳洲出世紙同一條驚人既生仔費，唔走數出唔到境 TIM！所以我地無雙非煩惱

都只可以攞到同老公一樣既visa!咁先好！唔會有咁多雙非！

咪玩啦，我都想呀！小朋友出世係睇父母係咩visa！我生細女果陣仲係TR，所以細女跟我地一樣！申請PR同入籍小朋友都係跟我地一樣

咁如果父母其中一個有 PR ／ CITIZENSHIP (但吾响澳洲定居, lets say Singapore) ,個女响Singapore 出生, 但佢地而家考慮搬返澳洲,咁佢個女可以入籍同享受福利 ?? And his wife need to apply TR/ PR after arrive Australia ?

咪同糸hk 出世一样，bb一出世就可以去搅citizenship by descent 拿澳洲passport.

父母其中一方系citizen 先得。 PR 父毋，bb都系pr only.

bb都唔糸澳洲藉。叫你朋友再plan 下先啦。

singapore 冇dual citizenship 架wor。

bb可以跟PR 的父或母申請PR 如果打算搬返黎澳洲住。 Spouse 也要申請spouse visa .

咁媽媽申請spouse visa 時，应该可以加埋bb落去一齊申請PR.

我老公、仔仔、囡囡全都澳洲藉，不過我都唔可以直接入藉，你話你朋友有冇可能可以入藉，佢小朋友都冇可能係澳洲藉。
