我會準備炒工人，為免佢玩嘢，我會由開始通知佢炒魷起，叫佢執行李，叫佢簽收支票及機票，一路由朋友拍攝。

我可能遇到情況如下：
(1)
佢話侵犯佢人權，拒絕被拍攝。
我會話這是我家，有權影。佢仍然發爛渣，郁手郁foot。

(2)
佢要在agent 處簽收，因agent 會幫佢。(他做了9個月)
我是否在agent 處拍攝，而佢又拒絕被影，agent 一定會幫佢。

以上的情況，請問各位有什麼經驗？

I also filmed when I terminated my ex-maid, but she had no objection. I remember a post said you can terminate her at the Labour Dept. It may be better thou not convenience.

Question 1, call police for help if she 拒絕被拍攝 or 郁手郁foot.

Question 2, you better settle everything at Labour Dept. No appointment required. Just check which is closest to your home and the opening hour. 勞工處職員絕對比agent有公信力, 何況"agent 會幫佢".

It's not convient to settle at labour Dept because my friend & we have to go work. The another important thing is " 拍攝佢執行李" until she leaves our home. This maid is very tricky.

Pls note we pay 1)final salary 2) 1 month in lieu of notice 3) Pro-rata Annual leave 4) 1 day Meal & transportation allowance &100 from arrival of her airport. Sunday &labour holidays leaves have been signed by her everytime.

Because there's nothing she can claim us, we don't want to waste time to settle at labour dept.

It only takes you about one hour to settle everything in Labour Dept. After that, she can't sue/claim you anymore.

Agree. This is the safest way to settle it if you foresee that there might be problem that happens during the process. Yes, my ex-yan also refuses being video recorded all the time. The same may apply to your maid too.

I had the experience of settling it in Labour dept a few months ago and it works out fine. COnsider this!!

May I ask what does it mean when you say "settling it in Labour Dept"? Is it that we can call for the Labour Dept personnel to help when the maid's packing up in our home? Thanks.

Here below is the procedure I took to fire her (with immediate notice):

""Early in the morning, after sending our kids back to school, I suddenly asked her to go along with me to a place where I need her to help. At teh same time, I asked her to bring along the door key (I told her she needs to come back home on her own later) and to bring her ID card. Then, we get downstairs and I drove her to the Labour Dept. I kept silent and smiling all through the way, without giving her a sign of termination. When we arrived, I talked to the LAbour Dept staff first. Then, all of a sudden, I asked her to join me in front of the staff, and announce to her that I terminate her. The process takes almost an hour cus she disagreed all the time without a ground.

After the settlement, I drove her back to the place I lived and asked her to wait downstairs for me. Then I got back home to pack her belongings. All packed into a mess, her frozen food mixed with her clothes

. Soup mixed with snacks. Wet and dry clothes put together. Then brought it downstairs. Then briught her to present her to the security guard once again, telling the security gurad never to let her into the building again. Pass a photo of her to the security guard. ( Many residents were passing by and when they heard what I said they staired at the Sofa Yan from her head down to her toe----what a shame.""

This is to cary out the termination process in teh Labour Relations Division, in the absence of a Labour DEpt staff as a witness.

The main thing you do is to (in the presence of the staff), pass her the termination letter for her acknowledgement of recepit, and to settle eerything outstanding to er (outstanding salary, airticket, payment in lieu of notice,etc) and to get her to acknowledge receipt.

There won't be any service of sending a staff to your home to witness. You have to bring along your maid to the nearest Labour Relations Division for their staff's witness.

There is a risk but luckily this did not happen to me. It works out fine for me. On the other hand, if I let her enter into my house afterwards, there might be another risk that she attacks me or she may accuse me of attacking her, athis is even more risky. Another less important thing is the time...if I pack it I would make it fast (10 minutes), but if I let her do it she would take more than half an hour or even more than that.

Both alternatives have their goods and bads. Having considered both ways, I still chose to pack the things for her instead.

As we plan to fire her tomorrow (saturday). The labour Department is closed. We don't want her to stay any longer because she seem to sense we will fire her. Any other alternative method which will protect us.

Perhaps you can ask the security guard downstairs to witness the whole process...at least here is safety.

BTW Labour Dept still opens so in the morning on sat , isn't it?? (i'm not sure, my friend!)

I still suggest termination has to be well planned adn no major loopholes should be left for the maid to play their tricks afterwards.

I will plan to inform the building managerment office to arrange staff as witness if she refuse to aknowledge receipt of termination letter and run away. Otherwise, she might run away and hurt herself and claim that we hurt her.

5 days work for government dept. now.
