怎樣做？

Finally I told my Yan Yan that I will dimiss her next month because of her attitude and unable to perform household duties even she has been with us for 6 months. I warned her many times and also sent her back to agent to train again but she doesn't care about it and always askme to fire her if I like! So I decided to give her a month notice instead of pay her 3270! She was so shocked when I told her. She has laready took her days off for this month and she came to me later and said she needs day off on May 01(Sun), I said why and she said it's her sister's b-day! I asked if it's so important to you, why don't you tell me when you have days off on 4th and 6th? She didn't answer. This morning she told me she didn't understand why she has to work for another month, I should pay her extra 3270 and she can leave! She said she can't stay so long!I said if you can't stay so long, you can pay me back 3270 and then leave! Later I asked the translator from the agent to talk to her to make sure she understands! She asked the agent if she changes good, will I keep her? I said no and the agent said no too coz agent also knows her well for telling lies! Then she shouted to the agent and said she wants May 01 & 08 both days off . Agent aksed her why and she said cos she has many friend here! She even told agent that she doesn't want to talk to her! My agent advised me that she may走佬！I asked how come she thinks like that but she said it's only her advise as a translator! So I think of paying her 3270 and let go! But you know 3270 and air ticket also is quite a lot of money! And if I pay her extra now it seems to fall into her trap!? My mom said she will stay with us until she leaves! What do you think? After she signed all the documents last nite, I locked them all in the safe!

If I were you, I will not pay her $3270 and will not let her go on 1/5 & 8/5....haha. You should play with her since your mother willing to stay.

However, if you don't want to waste 精神 with her, then just let her go~~~

I feel the same too cos too much extra money to spend! Also I am having annual leave now till April 26 and my mom will stay the rest of the month! Of course I will not let her go on May 01 & 08 cos I think she tries to go out to look for new employers! I checked her room today and it seems that she packed something already! And I am sure she went out this afternoon while we are not at home! My mom said she will go to market with her starting from tomorrow! Anybody know what will happen to her if she haven't finished her 7 month's debt! And for her annual leave, agent said I must pay her $$! will half day count or will round up to whole day! I hate her so much that I don't even want to pay her extra one penny!

照我所知, 佢走左之後既錢係唔駛還既......但Annual Leave就要計番比佢.

同意,我仲會寫去入境署寫花佢個底,仲有劃死張回程機票個日子,唔俾任何機會佢再響度害其他人!

可以計返幾多日年假就放假，提早N日離開您家。唔一定要畀代年假的錢。要agent同您計清楚那一天完約，那一天離家，書面寫畀您（錯了，可保護自已，追究agent）。

小心工人反咬一口告您（我的印印偷野還告我欠代通知金！）

最好去勞工處問清楚。旺角火車站政府合署唔使點等，唔好淨係信agent

But I have checked with my agent and labor department, both said if I gave her a month's notice, I must have to pay her annual leave in cash!

Here is my advice if you terminate a maid with one month notice rather than give her a month salary in lieu of notice....

Before telling your maid the issue: -
1) Make sure you have a relative to look after your maid in that one month.
2) Put away all valuable things into safe-box.
3) Keep all documents [Her ID / Passport copy] in a safe place.
4) Discuss this issue with your agency and see what is their suggestion.

Telling your maid the issue: -
1) Take Video / Tape record
2) Find a Translator
3) Find a witness
4) Ask her to sign back the termination letter. Of course, you keep the true copy.

After telling your maid the issue: -
1) Fax the termination notice to Labour department
2) Fax the termination notice to Immigration department.
3) Fax the termination notice to your agency.[If they want it]
4) Keep your eyes on her. For safety reason, set a digital cam to monitor her performance.
5) Time to time to check your valuable things.
6) Care your FOOD. I don't know they will do some bad things in your Food or not.
