I shouted at her, she left and did not came back last night.

My maid just came two weeks ago. Overall her performance is OK but she has a problem that she is very afraid to take care of my daughter 4.5 years old. My daughter is naughty and would not do anything the maid ask her.

I know this is the problem of my daughter and taught my maid the way to handle my daughter especially when she home with her alone. But my maid just ignore my advice and just stop feeding my daughter and take care of her when ever my daughter rejected her. I had discussed with her seriously about the importance of taking care my daughter in this job but she does not want to take up the task and I might have to finished her if she still does want to take care of my duaghter. Yesterday evening, I was very angry and shouted loudly at her when she did not follow my instruction to wash hand for my daughter even I have told her to do it many times. I shouted at her and she cried and walked out the door quickly with only her purse. I did not even have the chance to call her back after she went in the lift. Because she just arrive HK with less than 2 weeks so we are afraid she will get lost, my husband and myself have been looking around our areas for almost four hour until 9:00 pm but could not find her, we waited and waited but she did not come back last night. This make me worred, she does not have any friends or relative in HK and she had just one day off so far since she arrived HK.I am afraid she will get to know some bad maid who might teach her the bad things. I think to the worst, she might sueing me for firing her without paid. But this was not my intention, I think she is OK but just need to learn and I would keep her if she comes back. I don't think she know the way to the agent and she only have around $100 in her purse, I am afraid that some maid will teach her to go to the union.

I can not report to the police since it is not yet 48 hours and I doubt that I can report the case to the labour department as I know they don't protect employer, I don't know what to do now, can anybody help :cry: :cry:

你快 d 備案, 個工人走左唔使等 48小時, 因為佢地成日有人走佬, 你而家唔係報警而係備案, 如果唔備案到時個工人有乜意外你就大件事啦, 你係經 agent 請呀, 如果係今朝快d 搵埋個 agent 傾傾,

Don't worry about her although she only came to HK for 2 weeks. I think she has friends or relatives as they are very clever to tell their employer that they know noboday in HK. Even though she had no friends, they cann easily make friends with each other, e.g. your neighbour's maid.

Report and fax to Police, Immigration Dept., Labour Dept and even Indonesia or Philip. consultant.

I would give you advise that you better not employee her even you come back home. Once you can run away once when you shouted to you, she will run another and another. Consider your daughter if you run away and may leave her alone. Can you gurantee not to shout to her even she does some wrong?

Report to police immediately and call your agent.. once she back... if i were you, i will not keep her as she dont want to take care of your daughter .. this is the main point and very important issue.

She is philippino. My agent was closed yesterday and so I don't think she went there. But I don't know if she would go to them today or not, I have told the agent to inform me once they found the maid.

I rang up both the labour and policy department about this.

The labour department said they have nothing to do unless the maid submit a case sueing me for not paying notice in lieu. They suggested to cc them a copy of police report when I reported to the police

The police department suggested that I tried to find her by all methods, if I still could not find her, then report to the police in person with her documentation.

One point you must be clear is that SHE RAN AWAY and NOT you do not employee her.

You NO NEED to give her any paying notice in lieu or money. On the other hand, she SHOULD give you paying notice in lieu or money. You CAN sue her for not paying notice in lieu.

Don't worry about them, although every maid says they don't have friends or relatives here in HK before you employ them, you will find out actually they have tons of connections here, no matter they are Yan or Bun! If she really doesn't have any friends here, she won't run away and not coming back! I think what you should do is report this case to your agent, also write a report and if you are not going to keep her, file the letter of termination of employment contract and fax them to both. Also a police record is reommended, I am sure your Bun learns hows to take advantage from you if you still feel pity on her.

If someone has similar case in the future, here are some steps can be followed: -

1. Check her stuff/suitcase is still there or not?
2. Check your valuable things are missing or not? e.g. Golden rings, Money note, jellwery, etc.
3. Call your agency to report it.
4. Go to Police station to report it as soon as possible. No matter it is within 48 hours or not.
5. Call/Fax details to Labour Department.
6. Call/Fax details to Immigration Department.
7. Take Video / Picture of her belongings.

8. Prepare all documents...
a) Contract
b) Annual Leave Record
c) Salary Receipt Record
d) Her ID copy
e) Her Passport copy
f) Calculated the last wages.

My relative's new maid only worked for 1 month and didn't come back to the house on her day-off. My relative called the police at midnight. She borrowed the money from another Filipino maid and flew to Philippines w/o bringing any belongings on her day-off. When the agent called to Philippines, the maid said that she didn't like the job.

Fortunately, my relative lost nothing except a month notice or a month salary. And the maid didn't get the salary yet.

I reported to the police this afternoon and the maid showed up at the agent and she told the agent that I fired her and pushed her out of the door without letting her take any belonging. I did not do that at all and can't believe that she would say that to the agent, she went to the philippino party last night and obviously someone had taught her to say that. My agent said to her that she must have misunderstood that I fired her but she said she does not want to come backto us and want to receive one month salary.

I am nearly crazy now because I need someone to work for me despirately and if she did that I can not hire some maid now and has to wait for the case to over which can take months.

From what I know her she is not that bad how come she changed in a sudden, my husband said even if she come back to work, there will be a lot of problem so better to let her go.

Your husband is right.

You cannot expect such a maid to act rationally : she is out to get what is most beneficial to her, not consider what is fair or best for you.
Don't be kind to her / too soft.

1. If you don't have the time / energy to "play" with her, you need to pay up extra $3270 now - this is just what she wanted.

2. If you have time and energy and don't want her to walk away with a $3270 bonus, you need to give her one month's notice and fire her, but she has to work for you within that one month to get $3270, of course you need to arrange to somebody to "supervise" her every move.

3. You CANNOT and should not keep such a maid.

4. If she refuses to return to your place to work she has to write a letter of resignation and she has to pay you $3270 1m salary in lieu of notice.

5. Get somebody to act as witness and ask the witness to write down what transpired and sign. (The agent ?) Get it all videotaped or taped if possible.

In any case it is most likely that you have to pay her $3270 for leaving now and starting the DH selection / training game all over again, or later after 1 month. So why not pay now if this person is already useless to you ?

千萬不要再用她了。希望在人間，試試問一問你的親人有誰可以係這段時間幫到你手，有時我們覺得難為情去問所以就唔問，其實可能問題就在於你會不會開口問一問。有時人間充滿希望及友愛的。當然如果真的不能搵到人幫你手當你在等你的新工人時，你只好放你的大假跟你先生一齊輪流照顧幼兒，又或者請鐘點解決你的問題，就算要生都有陪月請的。一個鐘點唔夠，就請夠兩個，到生時就一個陪月，一個鐘點再加自己或先生的父母，我看怕夠晒人力物力去應付當時的需要。

有時如果用錢解決得到而又付得起的問題，我就覺得唔係問題了。
