續約應要帶的文件 :
1. 已填妥的從外國受聘來港家庭傭工簽證/延長逗留期限申請表格 (ID988A)
2. 已填妥的從外國聘用家庭傭工申請表格 (ID988B)
3. 現時的新標準僱傭合約正本各一份 (ID407). 新僱傭合約須經有關國家駐香港特區領事館公證作實 (如該駐港領事館有此要求)
4. 傭工的旅行證件正本
5. 傭工的香港身份證副本
6. 僱主的住址證明 (正本及副本)
7. 提早續約同意書 (注意 : 通知期一定要用入境處個日子印蓋落去先接受)
第7點提到之同意書, 可直接下載填寫, 處方亦會隨ID407合約派發.

下頁
- 供已終止現行僱傭合約以尋求提早續約之僱主及外傭填寫

如正常情況下續約 (即因合約屆滿而續約, 並無提早), 則無須提交此附件.

不過, 今日O係IMMIGRATION個web度搵到一個template, 用住先啦....

NOTIFICATOIN OF TERMINATION OF EMPLOYMENT CONTRACT

Termination of current Employment Contract by consent for advanced contract renewal. (呢個係我初步draft既wordings, 唔知可唔可以咁寫!!)

Notes:
1.
Both the employer and employee should each complete a set of this form upon termination of the contract.

A copy of the other party’s written acknowledgment of the termination should be attached by the employer and employee.
4.
Both the employer and employee should observe Clauses 11 and 12 of the Employment Contract upon termination of the contract.

Dear ellawayc,

Have you confirmed with Immigration Dept. that it's acceptable for the employer & employee to sign a mutual consent to terminate the contract immediately?

According to clause 10 of the contract, the contract can only be terminated by 1 month notice or 1 month salary in lieu of notice.

If Immigration do accept termination by mutual consent, here is my suggested draft:

This agreement is entered between ......... (employer) and ..........(employee) on .............. 2008.

Both the employer and the employee hereby agree to terminate the employment contract (D.H. Contract No. .......) with immediate effect for the purpose of early renewal of the existing contract.

Both the employer and the employee hereby agree to waive the requirement of giving 1 month's notice or 1 month's wages in lieu of notice stipulated in clause 10 of the contract.

jp, 如你以下咁講mutual consent的話, 係咪如果bunbun agree waive 埋return ticket都可以呢? 有冇人知入境處接受嗎? 真係冇理由白白比多幾仟$$個bunbun...

So, I personally don't think the Employer/Helper can consent to waive (A) the 1 month's notice/wages in lieu of notice requirement; (B) return passage

中文版無用呀,因呢封信係比僱傭雙方簽的,中文工人睇唔明嘛.

問 62：	遞交提前續約申請需要什麼文件及表格 ?

答 62：	僱主及外傭需分別填寫表格 ID988B 及 ID988A 。其餘所需文件包括 : 新舊合約正本、外傭旅行證件正本、外傭身分證副本、僱主居住證明正、副本及僱主及外傭雙方簽妥作實的提前終止合約通知書。此外，我們可能按個別個案情況要求提交進一步文件。

immd 有無限制話七月頭通知解約再續約唔可以呢??

My suggestions:

Dear Sir/Madam,

Application for Advanced Renewal of Contract

This is hereby confirm that agreement is reached between .... (“the Employer”, holder of Hong Kong Identity Card ....) and .... (“the Helper”, holder of passport no. .... and Hong Kong Identity Card ....) to terminate early the existing employment contract (D.H. Contract No. ....) on .... and to enter into a new employment contract (D.H. Contract No. ...) with effect from ....
The undersigned parties also acknowledge and commit on the continuity of employment relationship between the new and old contract.

We should be most grateful if approval would be given to the captioned application for advanced renewal of contract.

FA姐，我地可唔可以加多兩條：
1. 工人答應續新合約後年資從頭計起
2. 由新合約開始，無論工人與此僱主服務多久，都不會要求 ...
