My old maid stayed with us for 4 yrs till August. Upon the renewal of the 2nd contract with us, she clearly stated that she would return to the Philippines for her marriage and would not return to HK. So, we proceeded to hire a new maid this March from an agency.
This July, my old maid said that she was sacred of getting married and would like to stay in HK. However, as we had paid for the agency, we denied her request. With our good comments, she quickly found a new employer from an agency.
To our disappointment, my new maid offered very sub-standard services: bad attitude, disobedient, dirty, slow, just to name a few. My old maid, at the same time, does not stay happily with the new employer. So, we are thinking of employing our old maid and terminate the new one.
May I ask:
1. Is it good / possible to terminate terminate the new one and to employ the old maid? What are the procedures?
2. What about the tax that I've paid to the Govt?
3. How to count the year of service of my old maid - a new employment or the 5-yr? Do I have to pay the long service money to her next yr?
1) it's no bad to re-use old maid if both of you & maid is not happy now.
2) tax can be transferred to new maid
3) if you don't want to pay long service money, you may ask your hubby to sign a new contract w/ your old maid instead of you. But tax cannot be transferred if not the same employer.
