I need to terminiate my current maid A without notice (give her one month salary in lieu of noitice) and hire a maid B who's currently in HK to replace maid A.
But maid B hasn't finished contract but will be terminiated in Dec 06 as her employer will emmigrate to Canada. Can anyone help me? I talk to two agency but they have different advice about the procedure and I want to replace my maid on time in Dec 06 because maid A was so irresponsible and allow my bb to cover her face with blanket. When I scold her last night, she told me to fire her instead....
and I really don't know what to do...
Very desperated now.

I just employed a pre-terminated contract maid so i knew the procedure, i didn't process it through agent since she was referred by my friend.
For pre-terminated contract maid (yr maid B), the process should be below:
1. she need to apply for a "ID522" (required for those pre-terminated contract only) in the HK Immigration Dept first. To apply for "ID522", she need to present the previous employer's contract, her passport, previous employer's release letter (stating the reason why need to pre-terminated the contract), your green contract x 4 copies with her. Then she need to wait for around 3 weeks to go to Immigration Dept again to see if the ID522 is granted (if immigration check over her record and found that her record is not good, ID522 will not be granted and she cannot stay in HK to find a job).
2. After getting the ID522, she need to go to the Philipine Consulate to process the new contract with u, together with
Pre-Terminated Contract
Old contract
New contract (1 set)
Passport with valid visa
ID 522 (HK Immigration appointment letter)
Duly-accomplished registration form (available at the Consulate)
Hong Kong ID
3. It will take 4 days to go back to consulate to get back the stamped contract.
4. Then send the stamped contract and documents to the HK Immigration Dept again for processing working visa. She can get the working visa at the same day.

the new maid is ok so far, in fact, her performance is just as the comment from my friend's friend (her previous employer), she has no experience in taking care newborn (I hv a baby boy at 6 mths) but she is willing to learn and now can do all the basic baby care jobs, say changing diaper/feeding milk cereal/taking bath etc after 2 weeks of practice.
The most important thing is that her attitude is good and polite, not as my previous maid that always long face and shaking things/appliance when unhappy or being ordered to do things. This is also the reason that we employed her after getting this comment (good attitude and no long face for 3 years in my friend's home) from my friend. Also, my friend's comment that she cannot cook well, but for us, this is no big deal as we don't need her to cook. Since the maid is come from referrals by employer (not referred by maids, I got 2 referrals by friend's maids but those 2 are really bad and even no show at the date to process Immigration doc.).
BTW, I just received a "payment collection letter" from Finance company today saying that "final notice", my previous maid (the one I fired on July) owing them $33,XXX. Then i phoned the company and told them the maid was fired and they are so co-operative and said that "ok, we will update the case and collect her money in her home country"...seems that this is common to them.

Thanks for your procedure. So,
1. YOu did it by yourself and no need agency? Can you terminate your maid at the same date that your new maid reprot duty?
2. Where I can get the copy of green contract? I have searched Immigration website but can't find it. SO, I can sign the contract with my maid.
3. FOr ID522, does the maid go to Immigration and she can find the form? Can I download it website?

Yes ar, I asked my new maid to process the whole procedure (we even no need to go with her to the Consulate or Immigration Dept) and no need agency ar.
Q1.Can you terminate your maid at the same date that your new maid reprot duty?
- For my case, I terminated my previous maid 2 months before the new maid report duty. As my friend referred the new maid to me after we terminated the old maid (due to misconduct and we paid the old maid 1 mth salary).
Q2.copy of green contract?
For the green contract, it should be form ID407/IDC407K/ID407L, however, u cannot download the form from website, u hv to go to Immigration Dept to get a whole set original copy for filling in. It should be a Yellow colour booklet with instruction to fill inside.
Q3. ID522
For form ID522, also it cannot be downloaded. It will be issued from Immigration Dept after yr maid have submitted the document in Q2 + her previous employer's release letter (stating the reason for pre-mature terminating the contract) and old contract. After yr maid have submitted the documents to Immi. Dept, they will give your maid a letter stating the next appointment date to get the ID522, for my case, the next appointment date is 2 weeks later.

....正如sandra媽話頭,電去immg問好過問agent架......不過你要make sure maid B 係一定12月會過去你果度做..因為仲有兩個多月,人既變數好大...你係咪想同佢簽定約先??但想張約既生效日期就係Dec??
