請問bunbun 16Nov take 2 wks annual leave , 可不可以今天give her one mth notice to leave

My bunbun start work this year Jan, she takes 2 wks annual leave from 16 Nov to 30 Nov. But I want to release her , Can I give her one month notice today ??Then when she back to HK on 1 Dec , just stay 2 wks then can leave ?? Thank You !!

The reason why I release her because
She is 45 yrs old and she is the first contract here and told her Ex employer she only stay one contract here !
But I and my hubby have to work only my 9 yrs old Boy at home, she always complain to bring my son to school by mtr from TKO to Wanchai !!
And her cooking is very poor so we always go out for dinner.
She not willing to go with us to relatives' home because according to the Labour Ordinance !!!!!

Yesterday so funny I told her to buy 2 bottle of Bleach and Rice . And she said then she need to go 2 times !! I answer from 1pm to 7 pm Just only she stay at home !! What's the problem ????

First of all, if you bun start work this Jan, she don't have 2 week annual leave yet. Only when she finish her first year contract, she is eligible for 7 days annual leave. Therefore, you can not allow her to advance any leave at this moment and she is not eligible for any air ticket to return to Philippine.

If you want to release her, just give her one month notice now and she can return home after one month with your one way return ticket.

Thank you for your reply !
She take annual leave because I employ her local !
She finish her contract and start to work with me and didn't back to Philippines !!! So she take annual leave !!!

唔一定要返 philippines, 你可以去一去 macau, 出一出境便可. 不過如果佢做得唔好, 就襯未到一年 fire 佢啦.

You employed her locally, then you have to pay her return ticket but not annual leave. The annual leave should be paid by her ex-employer.

Then should I give the termination letter today ??
Or wait her back to HK to give her one month notice ?

You must know what your are liable for and what's not.

1. no matter how you employ her (local or overseas), she is only liable for annual leave only when she finish the first year of service. If you allow her to leave within the first year of contract, you can grant her "no paid" leave, and not annual leave. She is only eligible for single journey ticket from PHILLIPINE to HK for this no paid leave and the single journey from HK to PHILLIPINE should be paid by ex-employee.

2. If you want to terminate her, give her termination letter NOW because one month can be effective from the date you give her the letter.

When you terminate her, reminder to record the process as this is the evidence of what you offer to her and how she respond to your offer. You can bargain with her if you want her to return after her no paid leave.

That's why I am angry with the bunbun ! she always talk with me about the labour ordiance But I write down the holiday that count her had 7 days annual leave She didn't tell me the truth !!!!!'

I told my husband talk with her now !!
Because Bunbun like to talk to MAN !!!!!!!!!!!! :evil:
