移民問題

老公本身係澳洲CITIZEN, 佢都番左黎HK7,8年喇, 而家想成家一齊番過去, 但要申請我同囡囡過去, 想問下大家, 知唔知點樣會易批D呢? 同埋大概要等幾耐架? AND如果我申請STUDENT VISA過去會唔會易過申請SPONSED VISA呢?
唔該大家呀!!

I think once you husband is citizen, and you can prove you have real marrage relationship with you. Marrage Cert is not 100% ok, you need to prove the long reationship between you and your husband (like some photo to show you/husband with relative in the photo, letter, bankstatment or real estate with both name), birth cert of kid with showing you and your husband name etc.... then should be no problem wor.....

How do I know? Cause now I am part-time working with a migration consultant in Oz ma...... Heard too many case already ...... fill too many form by me already .......

Like what 卓宜媽媽 said, use a visitor visa to come here first. Then, apply the spouse visa here. Make sure you'll bring all documents here with you, including marriage certificate, baby's birth cert. etc. Even the wedding invitation cards will count. Thus, bring everything.

Also, if you have married your husband for more than two years and have a baby, you could be granted a PR instead of a temporary one. If less than two years, I reckon you should wait till your 2nd Anniversary, save you from obtaining a temporary visa.

I also have some migration questions…

I plan to migrate to OZ next year while my kids will be 3 year and 1 year old at that time.
I am afraid they will have problems in adapting to the new environment especially we do not have many friends there.
Can you give me some advice?

In fact, my PR visa will be expired next year.
I heard that we can extend the VISA by applying the Resident Return Visa (RRV).
Did someone apply that before? Is it difficult to apply and does the application take a long time to approve?

We really do not know whether we should leave HK to a new environment.
Can someone share the experience to me?

I think it is quite easy to get the Resident Return Visa as the questions in the form is very simple, but please make sure you haven't leave oz for more than 5 years, otherwise, everything will go back to the very beginning and you need to apply for the Permanent Resident Visa again! Like me

So u mean you leave oz for more than 5 yrs, and you lost your PR status so that you have to apply for PR visa again? Does it take a long time to get approval?

For RRV, I need to show compelling reasons why I did not go back to OZ in the past few years. I don't know what reasons can be identified as compelling reasons. Does anyone applied before and can share some experience?

Yes, I am now applying for the PRV again, I have no idea when can I get it, the staff told me it takes about 16 weeks.

The one you mentioned about Compelling reasons that means something unfortunately happened such as serious diseases, death of parents.....

Any other reasons that you couldn't go to OZ is just your own decision, they never accept those reasons! (that's what they told me).

As I know, the policy has been changed after 2007. If you get the PR after 2007, you have to live 4 years instead of 2 for citizenship. You can browse more details at www.immi.gov.au

Hi Tvoincy,

For the new residence requirement of 4 year will only apply to people who become permanent residents on or after 1 July 2007. If your PR was granted on Nov 2007, then the new residency of 4 years applied.

People who became permanent residents before 1 July 2007 need onlymeet the old residence requirements (presence in Australia as apermanent resident for periods amounting to two (2) years in the lastfive (5) years including one (1) year in the last two (2) immediatelyprior to making the application)

Hi JJ_Chow,

Follow the change of legislation in new resident requirement last year, the government also launched a new policy that, effective Oct 1997, for anyone who yet apply for the citizenship will require to take an English test before they do so. Any citizenship application shall be neglected if an english test had not be taken or if had failed the test.

Hi ngmammy,

Long time no talk. The test is to test the applicant's understanding of Australian history and values. Although the test is conducted in English, the aim is not to test one's English ability/level.

You can contact the department to obtain the booklet to study in advance.
