Dear Happy Parents Enjoying Happy New Year

We're shocked to discover our Rental Unit was in a TOTAL MESS when returning Australia on 20 Jan, thanks to the Agency letting their Builders into our Unit, starting all these NON Essential Repair Work during our absence, AND still Ongoing.

After exploring other ways in settling this matter with the Agency without any joy, we're to apply for an Urgent Hearing with the Small Claims Tribunal, trying to hold this Most Powerful Agency in Caloundra (The Family owns most of the land in the area) Responsible for their Irresponsible Acts.

If have time, I will provide more details, as an Opportunity to remind others the Rights of a Tenant and the Duties of an Agency.

Thing May Start to Turn Around

Hi Chelsea

No worries, the Old Chinese Wisdom once stated,

"Extreme Leads to A New Direction".

My CNY Gift was a Builder knocking on my door, asking when was the best time to start the "Routine" Repair on the day!

My Birthday Gift for today was to submit Urgent Applications to the Small Claims Tribunal!

And my St Valentine's Day Gift for Tomorrow?


















Yes, the Builder is coming to do the Never Ending "Routine" Repair!

Have to see things in a Positive Way - and find a way out!

Every Day is a Happy Day.

Court Date is Fixed

Dear All Peaceful Parents

The Court Date is fixed.

I'm to present my Urgent Case to the Small Claims Tribunal, presidey by a female Magistrate, on 20 Feb.

It will be interesting to see how the Tribunal is run and what is to happen on the day.

The day a Small Chinese Helpless Family taking legal action against a Big Local Billionaire Family.

Court Case Won

Dear All Peaceful Parents

Court Case won on 20 Feb. The Magistrate had ruled :-

1) I could terminate the Rental Agreement WITHOUT any cost to me, the lease is supposed to end in Oct 08. And I had asked for 2 week time to leave the Unit; and

2) the Powerful Agency was ordered to pay me $258 for compensating the clothes damaged by the flooding in the bathroom and the application cost I had paid for the hearing.

So, we will be very busy - and we may change from Renting to Buying. We have 11 more days before moving out of our current rental!!

Seems to be a Good Buy

Hi ngmammy & Chelsea

Yes, I have finally had some Good Luck after all these Bad Luck recently.

It seems to be quite a Good Buy for a Lakefront Brand New House.

When I have more time, will give more details why and how I took my rental agency to court and win, then how I got this Good Buy.

I only have 5 days to move out - have to find the Holiday Rentals for the time being.

What one has learnt from Our Experience

Dear Patiently Waiting Parents

About 2 weeks after moving into our new homes, we finally have a sense of Settling In and have time to share with you what one could learnt from our recent Renting Experience.

1) Never Feel Embarassed - do a Thorough Check.

When viewing the rental property last Sept, we noticed the carpets in the master bedroom was a bit loose. We were embarassed to ask the Agent and presumed it was due to last tenant's neglect.

But we subsequently discovered it was because the Unit was Flooded Twice Before. The Agent had NEVER advised us of this Fact BEFORE us signing the rental agreement.

So, never take things for granted. Do a proper check to avoid potentail great problems after moving in.

2) Never take Agent's Words - ask them to put their Promise in Writing.

The Agent assured us the carpets would be fixed BEFORE us moving in - and it did NOT happen. She stated that it was the Insurance Company, the Builder, then the Weather etc., (Except herself) to blame.

So, if you have found a problem, make sure you put the problem has to be repaired as a Conditon - allowing you to freely walk away from the agreement if the problem is NOT fixed in time.

3) Never Give Up Your Rights.

I had repeatedly told the Agent she should have advised us the Unit was Twice Flooded before, and we were about to make a complaint to her Boss. She then offered to reduce our rent by $50 to $350 a week.

4) The Landlord has the Duty to ensure the rental property is Floor Free.

As such, the Magistrate ordered the Landlord to pay us the compensation - our clothings that were damaged by the bathroom flooding + the cost of us bringing them to court.

This incident has shown that Noone is above the Law, including one of the Most Powerful Families in our city. (Although our local newspaper finally decided NOT to publish our story, even after its reporter had came visiting us and taking photos of the damages - the Powerful Family happens to be the Landlord of the newspaper!)

Fate, I'm new in Oz forum. Thank you for your really good sharing. I can't really remember where you live, I just saw you about a trip to HK in another topic.


Our family (with my 2-yr old son) will move to Sydney in this summer. My husband will start a home search with a property agent in June. Would you pls PM me for the name of the company and the agent? Try to rule out some not-so-good agent. Thanks.

Have Tried Other Avenues

Hi honeybogi

I did try other avenues before taking the Agency to Small Claims Tribunal.

I had contacted Channel 7 & 9 - they did not respond.

I also tried the Residential Tenancies Authority (www.rta.qld.gov.au), but the Agency refused to resolve the Dispute informally.

I then complained to the Office of Fair Trading (www.fairtrading.qld.gov.au), which has initiated and investigation but has yet to come back to me.

I finally cornered the Agency with its Professional Body, Real Estate Institute of Queensland (www.reiq.com.au), and the Owner of the Agency, one of the most powerfu families in Queensland State, then offered to meet me at his office at a time convenient to him to discuss my concerns.

I then told him I was busy in ensuring their builders doing a clean and tidy job at my home, so he should come down to my home and at a time convenient to me to meet me! So, we have never met.

I also reminded him of its Obligation - it was NOT about Money but about Responsibility.

Everyone has thier Responsibilites - noone can run away from them. I advised him the compensation of $258 I got from them was donated.

Most Agencies are the Same

Hi Harris_ma

Welcome to your planned Dec arrival in Australia.

We live in the Suburb of Pelican Waters (ww.pelicanwaters.com), in the city of Caloundra (www.caloundra.qld.gov.au), of the Sunshine Coast Region (www.sunshinecoast.qld.gov.au).

We are about one hour drive North of Brisbane, the Australian Third Largest City - Gold Coast is about 45-minute drive South of Brisbane.

The Agency is the Henzells - www.henzells.com.au, they have three offices, ALL in the city of Caloundra. This means you will NOT find them in Sydney.

But, almost every Agency is the same - they will NOT tell you everything you need to know. You have to be very careful.

You are very lucky, though - ngmammy is a very Knowledgeable and Helpful Mum living in Sydney - she should be able to guide you along the way.

When our family met with ngmammy's in Tsing Yi Gathering last Dec, I joked to her, she should considerestablishing a "Relocation Service", helping to be arriving new immigrants to, amongst other things, check the renal property for them - to ensure the new immigrants to have a Great Start.

I suppose you can't wait to start your New Life in Australia?

Thank you very much. BK mums are very amazing, they may live far apart from each other but here I find a warm and supporting community!

May be I've to ask ngmammy for more info, but now what concern me most is where to live~~ And about my new life in Australia, I don't even know what kinds to questions to ask~

This new environment is exciting indeeed; but I had never been a full-time housewife, not to mention a full-time mum~~ Scaring.... Hope I can handle it well.. Any cheaper childcare? If a child attend 5 days a week, it's like renting another accomodation.. how come?!

Help is always Around

Not just ngmammy, but also every parent in the Sydney Parent Club is very helpful and therefore eager to share with you their Experience.

Since your child is still relatively young, Where you live is very much Determined by where your Husband Works (and whether both of you can drive)

One of the best options is to live closer to a mother from the Sydney Parents Club, having More Support when it is most needed during the initial settling period.

And I have noticed you have already started communicating with them and I have no doubt they are to give you some vey handy tips in where to rent, which school is better, which childcare offers more, which bank suits your needs, what to bring from HK etc.

I do NOT have the Local Knowledges and Experience like they do in respect of Sydney - which is Very Important and will make a Real Difference in many circumstances.

I could assure you being a Full Time Housewife or Mum still does NOT give you much free time - time just flies when one has a young child - you will be lucky to have some time to have a nap and re-charge yourself!

I have no doubt you are now in the capable hands of Sydney Parnet Club. But, of course, if you wish a Third Opinion every now and then, please feel free to contact me - I will try my best to give you some lights.

Meanwhile, just relax and start counting - you will soon be in Sydney - and having tea (+8888) with all those Mums that have been helping you!!

Thx for your comforting and encouraging message. I'll try to get more supports from the Sydney mums, even though I may not be able to live in Hurtsville, where most of them live... my husband refuses to live there :p

I starting a prelimary packing procedure - throwing away some really unnecessary things... it hurts a lot when I've to throw my 'history' away ...

Full time mum is a demanding job, and my way-out may be the day care center... but how come they're so expensive?!

Good Reasons

Sorry for not responding sooner - I have started a post in the "UK Parents Club", so sometimes I am a bit confused and therefore forgot I have several posts in the "Australian Parents Club" too. Must be getting old!

Everyone is Different - someone likes Roast Duck and someone likes King Prawns. It does not mean Roast Duck is Better than King Prawns or vice versa.

So I am NOT that surprised your husband prefer living somewhere else - he must have some Good Reasons, in addition to his Personal Preference.

History makes us What we are Now, but if one is too pre-occupied by the Past, then they may not be able to move forward for a Better Tomorrow. I am glad that you have the Guts to throw away some old things - something that you may not know you actually have them - until now!!

If one child is Demanding for you, so there are Good Reasons for the childcare to charge you a Fortune then - they have at least 15 children in a class at any one time. Can you imagine yourself having to settle 15 young children?

Full time Mum is very hard work, but if money is not an issue, one day one would notice one very fundamental difference between a child rasied by a full time mum and a part time mum - it is all Worthy in the end.
