I'm going to the lb tribunal to fight with the PK Yan next week.

One day I pointed out her mistake and tried to correct her (not scold at all, but urged her in a mild tone), she appeared very angry and suddenly said, "I go out la". Then within 9 second, she took her handbag (not other belongings) and rushed out. I thought she was angry to have some rest time out and so I told her to taked some time off and come back to talk about her mistake at night. (Actually she has the habit of going out for personal businesses as time-off during week days, but of course I usually allowed her, that's why I assumed her going out for a rest to calm down is just normal). I couldn't sense that she was to run-away. That's it. But then she accused me of expelling her out of house and do not let her back. SHe even described how I throw her stuff out of the house, OMG. And of course, the argument is on whether I fired her at that point of time. Of course, I did everything afterwards to look for her, and urged her to resume work (I kept all the letters/things that I've done and sent to the tribunal as supportings already).

May I ask mummies here that, if the judge asks me anything about "were you angry", "were you dissatisfied with her performance" , "did you scold" her, "did you thought of replacing her cus she's such a bad maid?" I should tell the judge "not angry", "not dissatisfied" , "no thinking about replacing her at that moment.", would be advantageous to myself.

Anybody here can help please???

Just today i find that i lost 8 pounds since she's gone. Iam very shcoked and hope the reading is a mistake (it's my lowest record ever). Now my new maid arrived and it's a little better.I am always tired and no appetite to eat.

Oh really ? You go to tribunal or the labour realations office? I'm going to tribunal for hearing exactly on 4 June. Shall we meet there?

You can say
"were you angry" "I am not happy."
"were you dissatisfied with her performance" "Of course I am not happy with her performance and she always walk away of my house without my permission."
"did you scold her" "I only urged her to correct her mistake."
"did you thought of replacing her cus she's such a bad maid?" "I have no intention to replace her. I need a maid at home. If I need to replace her, I should have started looking for another one but I didn't."

除了同意咁答之外，其實呀官人會針對你有無出足糧同放假，僱主換唔換人其實唔係重點，重點係個工人claim你乜 item而唔係你炳佢or想換佢...
呀Fa去了泰國公幹，會過幾日先返，你想知見官大約會發生乜，除了工人會加告額外項目之外，通常會拖你上多幾堂，等佢有足夠時間搵新水魚，另外你頂唔順投降的話，佢又多一筆錢著草。

希望你地唔好放棄，俾足自己應份比果份，就唔好比額外錢佢地，只會令佢地覺得乜都要告僱主，形成習慣，亦成為我地香港僱主負擔，大家一齊努力！

I'm so thankful for all your support. Your words really comfort me. It's really like sitting for an open examination, where you will never know what will be asked in the exam. All in all I will do my best and be confident.

My C6 also told me to "just take it as part fo my learning processs". He says I got to face such experience to enrich my life. Especially, he says, "going to the court for a hearing is a very precious experience. Judges are not really very very high rank persons but they are jsut doing their job when they attack you" That's what he says.

I hope I can keep updating my case here in order to help those who face the same problem.

For now, I need to eat a lot to keep up my weight and health.

Yup. My C9 always say,"what an interesting game to play. How I wish I can be the one to play this game!!!". Isn't he rediculous?

And, luckily, my ex-Bun (who had some handover period with teh stupid Yan) gave me full supoort in this and she has written her statement to the tribunal to evidence she has actually seen the PK Yan's taking some rest days. We've chatted and she opined that this Yan need to learn her lesson.

Ha,ha,ha. I'm surprise that what your C6 said was absolutely what my C6 said. He encourage me to play this interesting GAME and fright for my right, because we do nothing wrong.

係呀！個個法官，一日都要處理幾單外傭告僱主o既case，所以佢地只會盡力叫僱主和解=比錢

但係遇到個工人真係屈得太勁，通常法官會幫番僱主轉頭，要睇僱主整體表現！

Why we need to fright with the maid, because I want to tell the maid and all their friends that Hong Kong employers are not all stupid.

I am sure you have created a record among the maids to give them idea that it's not that easy to get the money from employers which they don't deserve.

Finally I attended the hearing this moring. The female judege is "inch" but doesn't attack both teh maid and me much (though she inched both of us too).

At last both parties agreed for a conciliation (cus I know I cannot afford more time on it, I'm really exhausted). Then, after getting out of the tribunal, my C6 was responsible for negotiation with the Officer. I did not have compromise with my C6 beforehand about the concilaition amount...So, , c6 started with offering an extra amount of $1400 apart from those she really entitles (like air ticket, outstanding wages). That means the argument was on $4000, out of which I paid $1400. And immediately the maid accepted. (Then I regreted since it sounds like this amount is far above her expection and that's why she accepts without hesitation) . But anyway, my c6 told me afterwards that he doesn't want me to get involved in this affair anymore. My mood is still OK now, not happy or sad, but just want to totally forget about the PK Yan's face ASAP.

One thing worth noting is taht the Yan has no Christian parties' legal advisers to accompany her. THough she has 8 to 9 other stupid maids to attend the court with her. A few of them even bowed to me to say thanks when I left.

It's actually a nice experience for me to aprticipate in teh court. Though I may not say I enjoy, but it widens my horizon....
