有冇人俾工人上去勞工處告過?

之前個工人響在職期間整爛左我屋企好多野,我跟足法例每個item唔過$300, total唔過佢四分一人工咁扣佢,但係估唔到佢走左之後黎告我.最慘係佢走果時我搵agent做証,agent又同佢law晒d証物走,如果到時去到勞工處我冇prove咁點算?有冇人同工人上過去勞工處做case? 我問番agent佢又唔覆我叫我同佢地財務講,點算?

我有去過, 因為我的前工人偷了我們的錢, 我們不但不能扣她任何錢, 還要給她最後一個人工加機票..但工人反而要求我們要付她返菲律賓之後的內陸機票錢, 加二天的TRAVEL ALLOWANCE, 另加他的DAY OFF 還有什麼什麼HOLIDAY的, 一堆, (因為是工會教她的,我們猜..) 我們不願意付, 她就去勞工處了, 我們被約去見面, 但發現勞工處的人很好, 一看就知道是工人要求過多, 因此有勞工處從中協調, 比AGENT 好很多!! 只要妳一切照法律來, 勞工處的人也會幫妳協調的!

have you got any statement signed by your maid that she had broken the various items, or taken any photos of the broken things, if yes, then there is the proof. YOU must try to find the agent as he got all the 'evidence' and he is the witness when you fired the maid

多謝各位媽咪既意見.armarm我都同勞工處傾過,果位小姐都好好人,佢話好少工人會為左咁少$$搞咁多野,我地亦會為左我地既原則至上去同佢地傾.最好笑係勞工處話個工人都認為係佢自已整污濁/爛既 (其中多數都係衫,而且係著過一次咋),但係未至於唔可以再著/用wor.係呀,如果d 衫度好多一達達既都可以著既,如果我地係住響鄉下既話.... :-x

I refused to pay the 1 mth's pay in lieu of notice as the maid has gone wacko, locking herself in the toilet screaming "I hate you, I hate you all" and banging at the door. On top of that, she always forgot to feed our newborn.

She went to the Labour Dept. The Labour Officer asked me to pay her something to settle and so I offered $500, telling her this was what she worth. Of course she didn't take it and went to the Small Claims Tribunal. I still refused to settle and went to the Court. The Judge gave us a last chance to talk face to face before opening the court, warning us that legal actions would be time consuming and costly, blah blah blah. We settled out of court at the end. (I can't say how much as bound by court documents.)

Our agent didn't help us at all in this case. They only asked us to pay to avoid the troubles. We never trust any agent since then.

I paid her less than 1 mth's salary for the payment in lieu of notice.

I got another maid in a week's time, fired her again in 2 mths' time.

I became a full time mum for 7 mths, got a 3rd maid, and returned to work 10 mths afterwards. The 3rd maid is still with us.

Justjust,

Are your three maids all Philipinos? I have heard that some Philipinos now linked with some "bad" lawyer who knows how to play tricks to bring cases to District Court instead of to 勞工處.

My situation is similar as yours as my 1st and 2nd maids are fired in a few months and the 3rd one is a Indonesia who is going to finish contract in Jan 04. I need to plan for the new employment. How you get this new maid? If you could, pls PM me.

Yes all 3 of them are Filipinas. Although Filipinas are cunning but we wouldn't consider Indonesians as we require high level of English fluency.

We got the 3rd maid thru' internet: www.asiaxpat.com
It is a website targeted as expats but many of the services are very useful like domestic helpers, cars, travel agencies...

The maids pay $180 to place their ad there. We select whom we like for interview and got one who had worked for the previous employer for 10 years. Since the kids are already big (10 yrs old), the previous employer didn't need a full time maid and let her go. The previous employer paid her the full long service payment. I know that sometimes she would visit them on her day off.

Many people say local finished contract maids are very bad, which I agree. But equally we don't have any guarantee to get one from overseas. I am not completely satisfied with the current maid but who would? She is already 10,000 times better than our previous ones.

I also heard from my expat colleagues that they found good maids from asiaexpat.com. However, I have never tried searching from there as my in-law doesnt speak English, we've got to stick with Indonesians. :cry:

I am not sure but I think the website does not restrict the nationality of the helpers. Probably there are also Indo maids there.
