提早續約才放大假,係未只批一年visa架..

我個工人9月中約滿,我想續左約,8月尾放左佢個14日假先.9月1日返來.因為我個女今年升小一,同埋我夜校9月中開學.但agent話要約滿一個月前辦先得,吾係入境處只批個工人一年visa.咁到時又要出境一次..所以佢叫我申請完先同佢攪大假d野..咁可能要9月頭先可放俾佢..係未咁架??有無方法可以早d俾佢放假...吾該晒..!

You agent is correct.

My friend have this experience before, she let her maid had AL before the date of end contract (she suppose just the same cos the maid had 14 days AL), then after around 10 months later, they receive the warning letter from Immigration Dept.

凡係續約工人,visa係一年期,即係話續約頭一年內,要出境一次,第二年個visa先生效,而所謂出境,可以去深圳打個轉番入境就ok,唔一定要番原居地.

去澳門會唔會方便過去大陸呀, 返大陸要申請中國簽証喎, 佢即日來回都可以唔一定要過夜的.

If Macau not requir visa, then I think Macau is better. You can bring her back in the same day and then she can get the visa extend to 2 years.

咁係未我如果一個月前申請,入境處一批,就會係俾2年visa.咁我即放佢大假14天.佢返來(9月中),就會做到約滿先再攪手續.但我如果先放14日假,一個月前返來(即8月中),先入紙續約,入境處係會批一年visa同warning我..佢做滿一年便要去澳門或大陸一次(即日來回)先再批2年visa.但我如果再吾續佢,咁佢可否係香港住多一年呢??吾該晒..

去澳門交通費好貴,返大陸可以做落地簽證.

Of course you need to renew the contract first, it need some time to process ma.

After your maid got a new visa from immigration, they only release a 'one year visa' to her. After immigration got your maid's re-entry record, they will give her visa extent to 2 years.

I'm not quite sure. Will the maid need to pay for the China Visa?? And the ticket of KCR to China (for the maid) is more expensive than HK citizen. (Sorry, this is what I heard from outside, if it is wrong, please correct).

咁係未我如果一個月前申請,入境處一批,就會係俾2年visa ----> no, only one year for the new visa.

但我如果先放14日假,一個月前返來(即8月中),先入紙續約,入境處係會批一年visa同warning我.. -----> no, they will not give you warning at that time. They will give you warning after they check your maid did not have re-entry record after her new contract to you near one year. (this is what my friend received).

做滿一年便要去澳門或大陸一次(即日來回)先再批2年visa. ----> not really, it is within one year, then they give her the second year's visa. (you know one contract is for 2 years, if you don't let her have this 'trip' or back home, you are against the law). If you have a good reason, you can send immigration a letter, then you can extend (may be few months) to release your maid back home.

但我如果再吾續佢,咁佢可否係香港住多一年呢 ------> you mean you are not going to renew her contract? I think it is not possible for her to stay in HK for one more year.

That means I must renew the contract first. Then immgration give her one year visa. Within this year I need to let my maid go China or Macau right ???? ----> yes, or let her back home

After trip, the immigration will extend her visa one more year right ? Did I need to go immigration for extend one more year ? ------> You are with her during that time, she will get this when she pass through the custom.......

May I know go China or Macau is cheap ar ??? --------> Ummm..... I'm not quite sure bor..... you better check it by yourself about the ticket rate of KCRC or ship of you and your maid, (cos I heard that the KCR rate is different for the maid and for us).. so you have to check and compare by yourself.

但係agent同我講如果我申請左續約先放佢大假.咁佢吾使再係一年內出境一次..咁邊樣先至真架..如果始終都要出境一次,咁我不如早d放佢假啦.warning letter無咩問題架??係未呢..點解入境處咁鬼煩架,咩原因只批一年visa姐.人地都請佢做2年啦...唉如果我真可以早d俾佢放,我聽日就去買機票啦..9月放假真係好大問題架..因為我都係學校做架..9月開學先請假,到時佢有工做我無工做架...

In this case, I think you better check with immigration.

My friend just like you, she let her maid had AL in advance, then she got a warning letter (details I'm not quite sure and cannot ask her as she is having vacation). They said the maid had AL in advance is the personal deal between employer and employee. That may be the problelm of time of renew contract. You have to check clearly with your agent.

You know you are the one to be sue but not the agent if any problem happen....
