菲傭 ran away but borrow money from financial insitute

For urgent family problems, my maid took no pay leave to Philippines. Last Saturday, she just sent me a SMS message said her husband burned all her documents and she won't come back. I tried to call her these days but could get a hold with her. Apart from the 30 days notice she suppose to give me, she still owe me $2,000 (but I paid all her salaries, annual leave and air ticket).

:-( Even more ridiculous is I receive a call from a financial institution said she borrowed $30k before she left HK. That means she is doing this all in purpose. I'm afraid she've borrowed money from other insitutions too. Can anyone tell me what I should do now?

Will the financial insitution comes to me for the money? When shall we report the case to the police?

I am in hurry to get a good maid to take care of my 2 kids (1 yr old and 6 yr old) but I really don't know what to expect now. Our life is really like a mess. If you have any good helper, pls pm me. Thx.

寫信去入境處，話比佢聽個工人走左唔返先啦。

財務公司個度，如果已經知道個工人走左，多數無野，唔會煩到你。

下次寄住，工人不論乜野原因，如果唔係完約，佢要返鄉下，千祈唔好預支人工或借錢或比機票佢，佢臨走仲要佢簽定張紙，講明係佢自己要放假，如果佢o係幾時幾日唔返黎香港，就當佢擅離職守，僱主不須作任何賠償，仲可以要個工人賠償添。咁做即使唔可以令到佢唔走佬，但都可以減少損失，亦方便自己到時到候就可以搵過第二個工人，唔驚佢突然走番黎，話要賠償。

個工人真係好衰喎.

快d揾個新工人啦, 如果唔係小朋友點算呀. 財務公司應該唔會搞你既, 佢地知借$係賓妹, 唔關你事.

she is supposed to send you a letter of resignation then you can terminate the letter, otherwise you are the one who terminated the contact and she has the right to has the one month salary. Very tricky......please call labour department and they will tell you what to do to protect yourself! I had similar experience before, my maid went away and I sent letter to the immigration and terminated the contract then she sued me for the one month salary becuase I fired her with no reason ****REMEMBER!!!!!***** 擴工 can not be applied to 外籍家庭傭工, they can disappear for 2 weeks and come back to work and we still have no reason/right to fire her. Thats what the 勞工處勞資關係科 staff told me!! So you can not terminate the contract and say she 擴工 and she just told you she is not coming back on the phone and you have no evidence to proof that. Please call this number 24 小時電話查詢熱線： 2717 1771 and ask the 勞工處勞資關係科 staff directly! Be careful!

dichiu, yes, you may report to police but at this stage as the financial institution has not done 'anything', I mean intimidation or other criminal activity against your family, actually the police cannot do anything. I recalled that some mothers in BK have mentioned writing to the Immigration and Labout Departments reporting what had happened to you in relation to your maid. Get their reference no.s and request for a written reply. Later when you receive the letter from the financial institution, you'll have their fax and tel. no. then you can fax them the reply letter from Labour Dept. and Immigration Dept.
