On 26 Feb 06, I fried my maid as she stayed outside overnight without my permission (also no call was rec'd from her). I settle all the things in front of the agency.
Then after 3 weeks, I rec'd a letter from Labour Dept. about the claims (including one month notice, air-ticket, travelling allowance, etc... The officer said that "how many times she stayed outside and had i give her the warning before, if no, I should paid her the one month notice.
and the travelling allowance $240
The receipt of payment upon termination had signed by her and me (in front of the agency), and she know the air-ticket would deliver to the agency. Then I bought the air-ticket and the last departure date could be 31-Mar-06 and I told the travel agency set the date to 07-Mar-06. Then I delivered the air-ticket to the agency on 03-Mar-06.
After I told the agency "the Labour Dept called me about the claims", the agency told me she dismissed/disappeared in the boarding house and they delivered the air-ticket+passport to embassy.
Today, I rec'd two letters (one was plain post "inside my letter box" and the other was registered post "rec'd by my new maid - she was the first day on duty).
The bad maid claimed
1. wages in lieu of notice
2. rest day pay
3. air fare from HK to Surabaya
4. bus fare from Surabaya to place of origin
5. travelling allowance (2 days)
As I just got pregnant again, I take care 2 years old son for 1.5 month (I'm a working mom).

I found some adnormal (blood breeding) for a month (after I rec'd the letter from Labour Department), I'm afraid I will lost ... :-( :-( :-(
I don't know why the Labour Dept. only help the bad maid and just demand all the things from the employer
I am very angry. What is your maid's name and passport no, I will print a copy of this post and fax to the labor dept and immigration dept and ask them to contact your agent to prove you have paid her already!!! I will tell them if you lost your baby they must be responsible for this!!!

I told you what happen when I rec'd the letter from Labour Department after 3 weeks I fired the bad maid. The day I contact the labour officer - both my son and me felt v. sick. I called the labour officer and lost my manner and cried, I told her I just got pregnant, who responsible for if I lost my baby. You guess what she told me she only responsible for settle the case.
Yesterday I rec'd the letter from minor employment claims adjudication board, I become the defendant and the case would be heard on 10-May-06. I need prepare a defence statement at least 3 days before the hearing and fax to the board.
I also met my agent last night, she said her boss may not lead her to attend the court to be a witness. She just said she would try ask the permission from her boss and she would prepare a statement for this matter. :-( :-( :-(
What a unresponsible agent!!! The next time you call the agent again, you better record what they say to prove you have paid the bad maid. Don't worry and be careful, we will help you. Just keep us updated.
sorry to know what happened to u. it does happen when u employ a bad maid. don't worry about the hearing case is only between u and the maid, don't expect the agent will sit for it which they won't. just remember u hv all the required documents submitted to them on that day. why the travel allowance is two days but not one?
sorry not yet finished my comments - if u don't pay the one mth in lieu of wages think they will not let go with it, prepare to do it. remember don't let yr exmaid to get her friends or any other people from union to sit for the hearing with her, only settle everything with her and the officer in the room. other outsiders will help her as much as they can and make u more angry and lose yr mind on dealing with the case. good luck and take good care of yrself.!
不用怕上court我有個朋友試過,無難度嘅,官在前面,你同個賤人一人坐一邊,個官會問你整個事,會比佢閙完兇你言話你唔對,你應赔比佢(佢離鄉别井,just few thousand on your side is not a problem but on her side is a lot,
係都要你比d,我個friend後來由官叫赔3000,了事)
