試用期問題

請問如果有一同事上工就3 個月, 老闆覺得她表現唔好, 唔合要求, 現想終止, 是否需要補7 天工資呢???

Yes.

If no termination notice period is stated in the employment contract or no verbal agreement to the length of notice, then follow the Employment Ordinance - 7 days' wages or wages in lieu of notice during the the probation after the 1st month of probation.

唔係喎,做滿one month,就算試用期都要one month notice ga wow,if you want to know the detail,please call :27171771 勞工署熱線

One-month is required only if it's a continuous contract and no probation nor termination period is mentioned. Please refer to the following info from Labour Dept for details:

如 僱 主 或 僱 員 想 終 止 僱 傭 合 約， 須 要 給 予 對 方 多 長 的 通 知 期 或 多 少 代 通 知 金？

答1. 如 果 合 約 是 連 續 性 合 約， 所 需 的 通 知 期 或 代 通 知 金 如 下：
連 續 性 合 約 通 知 期 代 通 知 金
有 明 訂 協 議 依 照 協 定 的 通 知 期， 但 不 少 過 7天 相 等 於 通 知 期 內 僱 員 可 賺 取 的 工 資
無 明 訂 協 議 不 少 過 1個 月 的 通 知 不 少 過 1個 月 的 工 資


凡 僱 傭 合 約 有 試 用 期， 所 需 的 通 知 期 或 代 通 知 金 如 下：

試 用 期 通 知 期 代 通 知 金
首 個 月 的 試 用 期 內 無 需 通 知 期 無 需 代 通 知 金

第 1個 月 後 的 試 用 期 內 有 協 定 的 通 知 期 依 照 協 定 的 通 知 期， 但 不 少 過 7天 相 等 於 通 知 期 內 僱 員 可 賺 取 的 工 資
無 訂 明 通 知 期 不 少 過 7天 的 通 知 不 少 過 7天 的 工 資

如果7天通知期﹐
星期六辭職﹐返到之後的星期五(最後工作天)
星期六辭職生效
