My maid has stolen our money on Dec 10, and then the case was reported to the HK Police. She did not admit during the first hearing. Now I need urgently a maid, we have found one, but since my previous maid and myself need to attend the second hearing, could anyone tell me whether the Immigration Dept and the Philippine consulate will issue the work visa for us? I really worry a lot as no one takes care of my son now. I really worry the case might last for long and I could not have another replacement. And we have already paid her 1 month notice as per the Labour Dept.
I read the questions that you raised on the Oct 15th meeting, but could any one tell me the answers for these questions, I really worry a lot.
I think we could still report to the police despite we have no evidence, but this action might be rather time-consuming. I have heard some agents of Indonesian maids suggested the employers to call the police in such case just for a warning / evidence purpose, and ask the Indonesian maids to leave home in the presence of the police officer. A measure to protect the employers and avoid future arguments from the maids.
I can tell you that the application of your new helper will not be affected by the current court case. They are independent.
The immigration dept. does have sort of a "black list" themselves. But such black list will include only those who have had criminal records like stealing, child abuse, etc. instead of all the names that we as employers put in as complaints.

Could you tell me what did you mean by係佐敦-SHELTER到住緊就好麻煩, actually we have already reported to the HK Police and we need to wait for the court hearing as she denied she has done so. I know she's now staying as somewhat called "boarding house", I really could not imagine whether their union will teach her what to do against us. Ai........
We wanted to withdraw the case as we really feel the psychological burden and it's really time-consuming. She did the wrong thing, but it's also too bad to see her in jail..... after working with us for several years...... :-(

Yeah, we know that, but when we called the Labour Dept, the officer told us that we, as employers, is liable to give the maids the salary within 7 days of the date of termination; otherwise we are not acting according to the law. Despite I told him about the case, he said that there might not have impact with the Immigration Dept, but we will against the law if we didn't give her the one month notice period. And, it's too early to say who win and lose as the court case not yet finalised yet.
Like you, we've got the number marked for the bank notes, could you tell me why the police said your marked number is uncleared? She still owed us $5,000 but what could we do? It really seems that we have no protection from the Government but there're really quite a lot of areas that we might be sued by the helpers if we are not acting according to law. They might be able to say that they don't have enough money to repay this or that, but is it a fixed rule that as employers, we must have the sufficient money to pay this and compensate that?
It's really unfair to us but we have no choice.....
So just just, are you saying if the Immigration Dept knows the rationale behind such terminations, they won't allow them to come back to HK to work again? Or it's only applicable to a few years only. I heard that some people saying that it's really easy for the helpers to change their names in their home countries and then apply again to work here, do you know if it's true or not, if yes, how could the government protect its citizens in this case?
