錯既緊係:

所以就算無犯事都要坐監,
重要坐完之後宣佈埋未夠證據檢控既控罪,

淫審處:

警察話係"淫褻"就"淫褻",
淫審處話"不雅"就一定係淫審處錯,
法律既解釋權係係警察度唔係法庭,
話明警字兩個口

裁判官:
佢話唔準保釋唔關警察事,
雖然警察有要求,
不過裁判官又天真又儍聽警察講之嘛

Police sent the exhibit to OAT also. DOJ withdraw the case base on the result from police, not Ming Po. Don't ask me why do I know that. But I can tell you that the information of this case from the medias are not 100% true facts.

警方今次嚴重失職因為沒有做 Step 4 和 5！

(1) 警方竟然一直沒有將相片交淫審處評級！
(2) 知道沒有被評為淫褻後，沒有主動聯絡法庭！

若不是明報記者將相片交淫審處評級，鍾亦天至少要無辜坐八星期監！

問題係警方要告佢無問題,
但係又係唔係急得咁緊要,
人已經拉咗點解唔主動揾淫審處裁定要等報紙揾先知自己搞錯,
咁急既原因又係唔係殺一警百同摧攞彩呢,
上庭跟住就話人欠卡數一貧和如洗反對保釋
當結果係家吓咁自然 ...

I can't see any problem in this case. If you know the procedure ofjustice, you will knw what's happening. First of all, according to theHK law, the procedure of handling the case of "ossession of ObsenceArticle for the Purpose of Publication" is
1.) Arrest the suspect and seize the exhibit;

2.) Charge the suspect if the police has a good cause of believe that the article is obsence;

3.) Put the suspect to court;

4.) Send the exhibit to the Obsence Article Tribunal (OAT)for examination.

5.) Carry on the justice if the exhibit was classified to Obsence by OAT; Or withdraw the case when opposite.

On the other hand, Mr. Chung was detained by the judge in this case,not by the police. Police has power to detain the suspect people for 48hrs only. Detain him for 8 weeks was requested by the Department ofJustice, it was the decision of the judge.

The photo of this case was classified to indelicate by OAT, not by the police.
