I 'm so plazzle that I have received a letter from the Labour Reltaions Division that my ex-maid claim me for
1) wages in arrears
2) statutory holiday pay
3) others
She early terminate her contact by her decision on Mar 22, I already issue an air-ticket for her & she is supposed to leave HK on Mar 29.
I want to know,
1) she logdged a claim to me, is that means she is still in HK?
2) I have kept all the wages receipts & holiday receipt, shall I bring these to the conciliation meeting?
3) how I can win the case?
The conciliation meeting date is Apr15, 2008.

She claimed that I underpaid her in the first contract (she worked for me 4 years). But I have paid her salary by cheque & have the bank statement as evidence. I found that she even amended the salary slip and write down "2,000" next to the original amount.
The worst thing is that I don't have the complete signed record of statutory holiday & no record of the weekly rest day.
The phil. maid worked for us for only a few days and then stole money from us. We discoverd but she didn't admit.
Finally, she is willing to resign by herself and write a letter. We pay her the salary and she left at once.
However, now she complain to the Phil 大使館 saying that the agency and we forced her to quit . And now the agency tell us to write a letter to phil 大使館. Any one have the same experience? Any advice to us?
Did you ask your maid to sign off all the days off and pay in lieu of holidays? Even if she is not entitled to the Statutary Holiday (as she has not completed 3 months with me) I will ask her to sign off her "not taken the day off because she does not want to have no pay leave") to protect myself.
Don't worry! They are usually use this way to stay in Hong Kong a bit longer to find another job! Did you give her all the fee that you should pay? If so, you don't have to worry, just tell the officer what happen! And did you have any receive sign by her? Everything is base on evidence, you have got all the black and white paper to proof yourself, then the maid can not take $1 from you!
