救求！
今日係個衰工人生日，佢送左份生日禮物比我。
就係佢今朝走左，大門都唔鎖。
等我呀媽同我2個仔熟睡中，就走左。
帶左幾件衫，同支牙刷。

打左比agent，我跟住應該點做，報警會唔會太早？

又有update喇，個agent話響尋日我地走左後，佢就立即帶晒D錢走，所有行李留響agent到。因為agent hold住佢passport想佢比番D錢佢，到今日，個工人都無返過agent到。
我地都有諗佢會唔會走去勞工處，但係agent話佢響失蹤後有比resignation letter，話personal reason要resign，同尋日響agent到簽左mutual agreement，所以唔怕佢老作屈我。不過佢一日唔出現同離開香港，我都無覺好訓。

我個衰印4/4放假後走左佬，全部野都無拎走。
我自己大住個肚，要湊個大仔，又要返工，真係好辛苦；依家有D產前抑鬱，無啦啦會喊。

收到勞工署封信，約我28/4上去；佢話我shortage salary，無比佢放假，仲要claim埋我待通知金同車馬費！睇到封信真係嬲到震！
佢放假前仲話要寄錢返屋企，叫我出cash比佢；放假後走佬，竟然話我無比佢放假，仲要我比待通知金???!!

不過我每次出糧／放假都要佢簽收，多數出cash chq. 佢自己去銀行。又有佢放假同朋友影既相，仲有兩封財務信，希望夠証據啦！
但聽聞佢地有心屈錢，吾會甘易罷休；可能會有排搞！

pollyw, 記得拎齊証據上勞工署，仲要小心說話，萬一比佢捉到有錯，有機會觸犯刑事。Take care!!

MAy I knwo waht did you do aprat from calling the police? Any warnings that you gave her after she left your house? DId the maid make up major stories or lies during the meeting to accuse you? As for my case i thnk half month salary to pay her is already a very favourable thing to me (talking about further time and effort to spend going to the then labour tribual). But I guess my maid won't accept such terms cus she wants money so much and wants to stay for longer time in HK.

As far as I know, this kind of 走佬1-3days is certainly NOT misconduct even for office staff ! To know more about termination without notice and warning letters, see my sharing here :

When I go to the labour department,they will give you some advise,remember that the labour department is help the labour(THE MAID),they will try to persecute you to give up.The labour department just want to settle the case...........At the end ,I fight for that of coure, I only pay half month salary (because I have no time to challenge with them,but my friend she is a lawyer said I have my right),I settled with them not because I have no right,only because I don't want to waste my time.I take one day off to the labour department,my day off worth $1000,that"s why I settled the case.The employer always lost,but at lease we need to know our right.

I've enquired the labour depart regarding this. The staff advised that its bettert o issue warning letters (may address it to the agent address or or home town address according to the contract). And sometime time later another warning, and then final warning, before you can term her without prior notice. The fact that absent for one day only is not usually counted as serious misconduct....

for my point of view,the maid disappeared that is misconduct,even half day(except there have a very strong reason that she can proof, for example:she got accident and go to hospital,but she also have responsibility to inform you as soon as possible), I think that the employer have the right to fire her without notice or payment in lieu of notice,but you need to well prepare all the documents to proof it and call the police.I have experience too.

I've been really exhausted and fatigue in this 2 weeks. Oh my---it helps me lose my weight fastest ever! I told myself that no matter waht the result can be, I shalla accept to be a loser in this case but it's important that i'm not to lose my mood.

It seems popular that maids got run away recently.

No, I didn't term her. My understanding is that absence from work for only one day is not sufficient ground for employer to term without prior notice or one month pay. Need to wait still a longer time. PM me if you really want to share!!

All I'm worried is that she has all her belongings in my ohouse, and I'm afraid that she may claim she has $1oooXXX money in her drawer and held me responsible for it.

Hi Payesi, but my maid back to home after 12 hours.
She did not go to the agent. She said the agent did not help the maid, only help the employer.

Today, after we fire her. She also leave the agency and go the Christian association. As i have signed all document and recorded by video. Do i have any trouble ????

我教你啦!
(1) CALL AGENT一定要CALL AGENT, 佢冇地方去架.(上次我個工人去左得'christian assoication')因為呢D地方只會教佢地告我地.而且每日收工人食宿錢, 因此一個星期個工人洗哂錢之後.冇辦法返左AGENT到. 所以你一定要搵AGENT
(2) 報警! 而且搵真D你有冇唔見野. 而且仲要俾POLICE知道佢係不負責任地走左.
打唔哂.你有須要PM我, 我CALL你再同你講啦
我上次搞左成兩個星期先SETTLE到

Hi SandraLo, thanks for your reminder.
Today, the contract is terminated in front of the agent. The maid agreed that she is misconduct for her absence on yesterday and left my door opened. I have let her signed a letter that she acknowledged the issue happend which she breached the contract and a mutual agreement for termination without further claim for 1 mth notice salary....

The above all is recorded by camera that i do not force her to do so and it is witnessed by agent together.

The agent wants to take back her salary of past 20 days. But she refused. And I will send the airticket to agent for her in this week.

Do i miss anything else ????? please tell me....

If you have on hand her resignation letter, you can "ask" if she's willing to leave immediately. She can refuse because she has the right to receive that 30 days' salary.
