They are citizen now and submit double applications (Family-Sponsored F3/ F4) for me... but the application process is very slow now.
My planning is to send my daughter to there after primary school in HK.. i don't know if the visa will be available after 3 more years... really headache !!
CSPA 適用於妳们的情況, age out 的計算方法, 係以移民签証批核的年份, 減priority date 之年份, 得出数字(e.g. 9.5年)
以當事人擬移民當年之岁数 (let's say 25) 減去上述得出數字 (that is 25- 9.5=16.5)
只要最後之岁数少於廿一, 就受惠於CSPA.
(其他uscis 只是將算式複雜化, 簡單來讲, 只要Petition 時佢地係below 21. 都应该冇问题的)
但有一点必须注意, 就系申請人一定要係簽證current 後一年之内要移民, 否則就不能受惠於CSPA
另外, 要在遞交visa application and affidavit of support 時, 交上一份affidavit affirming that the above mentioned requirements are cimplied with.
after all, 妳的姪仔不会age out.
