thanks for your sharing. I told all the things to my agent & they talked to her, I think her Mom is really sick but not worst to die, my maid promised to agent to hold one months salary to me & accept to pay the body check fee when she come back.

She will not go back to Ind at this moment because agent ask her to call her family day by day to check the status, if the case become worst then ask me to talk to the agent, the agent will help her to ask me to allow she go back, so, I still have time.

Actually, her performance is acceptable & I can said I treat her so good, so...

Hi Pekklesiu,

So strange to see that all cases here have the common point, those yan yan are working well but finally they suddenly ask to leave or betray the employers who treat them good! So what's the problem? HK employer is so stupid to be cheated easily or simply reflecting their culture, ie. no responsibility and accountability!

Hope you can overcome the difficulties no matter finally she needs to go or not! Good luck!

YES!!!
Also, their culture:
1. NEVER SAY NO! they don't like confrontation.. so if they know they'll get rejected when they say NO, they;ll simply say "OK "

2.They're SO good in hiding their feelings in front of the EMPlOYER! even if they don't like what you've arranged for them... they'll just smile... but smile doesn't mean accept... smile is just to hide their feelings.

3. Their NO = " whatever la" " okay " " I'll think abou it la" or just QUEIT... no respond and smile.

4. Zero Discussion . when they have problem... they won't open up and talk about it.. they just ran away from problems.

I think this is all about their culture+education... normally, I found people with low education level are more likely to not open up and discuss about possible solutions.. they just like to run away from problems.

If your maid apply for leave, first she needs to give you written application and as employer, you have the right of reject her application and she cannot just go away under her own wish. If she does, then she is "running away" and can be regarded as she ends the contracts by herself. Then, you can claim her on not giving you notice period.

Of course, if you do not accept her leave and you decide to fire her in order to safeguide from her running away, then you need to give her 1 month notice or money in lieu.
