What about the HK Imm Dept stamp with your Indo DH's arrival date ? Add 24 months to this date.
i.e. if your Indo maid arrived on 10 Apr 2003 (according to Imm Dept stamp), her working visa should expire on 9 Apr 2003.
To play safe, and in view of recent experience that interview appointment can be more than 1m before contract expiry (some were around 6 - 7 weeks beforehand), and if I were you, I would call Indo Consulate around 7 weeks beforehand and try to make appointment. If they say it is too early you can still have time to call later.
Your Indo maid can take home leave (and go back to Indonesia) anytime between 9 April 2005 and 8 April 2006. This gives you lots of time to plan your own leave. No need / not necessary to let her take home leave before contract due. For convenience' sake, I would let her take leave AFTER 1st contract due than BEFORE/IN ADVANCE. If you let her take home leave BEFORE you've finished contract renewal procedures, you have to let her exit/re-enter HK once between 9 April 2005 - 8 April 2006, i.e. you have to take at least 1 day's leave during this period so that she goes somewhere nearby (e.g. China, Macau) and come back and get the working visa (of correct end date) stamped in her passport.
I also have one question. My maid's contract is going to finished in Nov. with me (2 years) and she wants to renew the contract wiht me instead of through the agent. And I told my mom about it, she said I have to consider if something happen to the maid in future, would that be better for the agent to handle than myself. Can you tell me the advantages and dis advantages of hiring a maid not through the agent? Thanks a lot!
I have query on the list of document required as stated by the Indonesian consulate such as
10. statement letters from parent/guardian or husband.... no objection to ....extend employment contract without agency.......
Does it mean I have to ask my maid's parent(she is unmarried) to write a letter to the Indonesian consulate that they have no objection and attach the copy of their Indonesian ID card (I dont know what is the meaning of family card)
11. Domestic helper has to send a letter .......
Does it mean I have to ask my maid to write a letter to the agency and send it by registered post in order to get a proof of letter posting.
12. Employer's guarantee statement....
As far as I know the legal cost for making a statment before a notary public is between HK$650 to a thousand something and it may not be so easy to get a lawyer to do this. Any suggestion.
10. Parent to write a letter addressed to Indo Consulate, ask them to mail this to your maid 1st so that you can hand it in together with the rest of your docuemnts.
I'm not sure about the family card thing. Ask your maid. Maybe they have something like a 戶籍card in Indonesia to prove that so and so is a member of that family, or they have an official in the village who can issue such document (most likely for $$).
11. Yes. I think a letter to INFORM the original agency that contract renewal will be done by yourselves will do. No need to SEEK THE AGENCY's PERMISSION.
I think one BK member posted somewhere (either under this topic, or in a separate topic under 論盡家佣) on this issueback in mid-June 2004. Try to search for it.
12. As this is a requirement by Indo Consulate, there is no other way out. Can only pay a lawyer for this.
(My guess is, this is just a tactic forcing the employer to spend more money, resulting in less savings from NOT using agency, thereby discouraging 自行續約.)
I also think it is a tactic for forcing the employer to use agency. I just consider wherther or not to renew the contract or to employ a new maid (most likely I will employ Philipino this time). BTW do you have any sample letter for the undertaking letter.
