Have you seen the situation the maid didn’t come to HK? In fact, should we consistently employ her?
{One day if you don't want to work with your boss anymore, do you thing your boss can force you to continue to work with him?}
What action can we do if the maid don’t want to come.
{Forget her!}
May you PM your company information to me? Let me to contact you for next employment if you have not in BK僱傭問題信箱.

Have you heard QBE's plan? Now, I see the plan is $975 for 2 years ($200 clinical expense per visit). Is the QBE company okay?
{Yes, QBE is a very good Insurance Company. But there is a risk if you buy it thru agent, sometime the agent never pay to the Insurance Company, then the Policy will not effective. To be safe, you better ask the agent can you pay cheque directly to QBE or not.}
I interviewed a Filipino who has 2 children last Sunday. She gave me a pleasant impression. Could you give me some tips regarding the following questions:-
1)Do you know if the standard contract period in Abu Dhabi is for 3 years?
{Middle East standard of contract is unlike like HK, the employer have to apply the working visa for the maid themselve. From my experiences, I had personally interviewed a lot of ex-Middle East maid's with 2 or 3 yrs finished contracts. You can request her to show you her old passport to check on her Abu Dhabi Immigration stamp.}
I heard that some agent would get someone to pretend to be the employer of the domestic helper so as to give good reference.
{You can call her employer during the night. Think of some excuse so you can ask her to pass the phone to talk to the maid. To go futher, you can even go to her present working address to check. However, no need to go picking needle in the haystack, relax and trust your own judgement.}
{Actually from the day you sign the contract with her after her last contract, there is a window period of 3-4weeks. You can evaluate her further on her performance. If it doesn't turn out right, you can terminate the application process without any compensation to her.}
Can I request for faster approval because I am in need of the worker to look after my new born baby?
{2 ways to do it. You can write a request for urgent process letter to HK Immigration Department and submit together with the maid application. Or even better, go with the maid when you are submitting the application and request to see the officer to explain your situation personally. Your personal presence in front of the officer will make a good difference.}
{Looking at yours and the maid's schedule, you can start to process your application now to save more time.}
Thank you very much for your prompt reply. Can you explain further about the window period? Say the maid's contract ends on 28 Feb and I sign a new contract with her commencing from 1 March. Does it mean that she can start working for me on 2 March even though approval of the Immigration Department has not yet been granted?
Does it mean that she can start working for me on 2 March even though approval of the Immigration Department has not yet been granted?
{By law, without a visa, it is illegal for the maid to work or do anything for you in your house. However, there are some potential employer will take risk to 'request' the maid to trial for a few days or even just to accompany her for a few hours such as to go market with her etc. to see if they are comfortable with each other.}
{Actually you can sign the contract now instead of March 02. The contract can be submitted to Consulate for processing first. After the release of contract from the Consulate, you can proceed with the HK Immigration application before her contract finished. This way you can save more time in processing & waiting for the work visa.}
i have a few more questions concerning my current maid and new maid
with my current maid, as she has already tendered her resignation to leave on 20th, she is liable to compensate us for the remainder of the contract i.e. 21st to 28th Feb (end of contract date) as payment in lieu of notice. If I want her to leave on 16th, then what would be the situation?
I'm a bit confused as her last working day is 20th which is a public holiday. But what is the common practice to last working day - work on that day and leave the following day or leave on that day?
Just wondered will my current maid's working visa be processed while she's still under contract with us? She went to the immigration the other day to extend her stay in HK (which has been granted) as well as submitting her new visa application with her new employer.
With regards to new maid, I am still waiting for the issuance of the visa. Her contract and paperwork and supporting letter to speed up the process were submitted to the immigration on 22nd Jan for approval. My agent says I cannot contact immigration until a file number is issued. Is that true? Can I contact the immigration based on the DH contract no? Or is there anyway I could speed up the visa application as it's been 2 weeks of waiting. I'm going to be without a maid in 2 weeks time so really am desperate to start the ball rolling again. Was told by agent that as soon as the visa is issued my new maid could start her training.
My mother's maid submitted her resignation letter with one-month notice and the last day will be 4 March 2007. In fact, she hasn't worked for us three months enough.
As we want to release her as soon as possible, is it okay if we make agreement with her to let her leave early instead of 4 March 2007? Is there anything we need to pay attention?
Do you have any sample letter for the agreement of early release?
{I am confused. Your maid is finishing contract (28 Feb) or she is resigning? Anyway, the regulation is as long as both employer and the maid agreed on which is the last day of work WITHIN 28 days BEFORE end of the maid's working visa, , it is consider as finished contract. From my understanding in what you had written, there is an agreement made between you and your maid which fallen within the 28 days. Therefore there is no compensation for/from either party. Likewise, now you want her to leave earlier on the 16 Feb, there is no compensation from you too. But please make sure that the last day (assuming it is 16 Feb) of her work is agreed by both parties. If not, it is best to stick back to the actual last date of work visa (28 Feb).}
her last working day is 20th which is a public holiday. But what is the common practice to last working day - work on that day and leave the following day or leave on that day?
{Last day, 20 Feb, is the day she will leave your house. As of what time in that day will depends on the employer decision (because she is still getting salary for that day). In your case, I would suggest you get her to agree to leave on 16 Feb because the following few days (including 20 Feb) are labour holiday, you will still need to pay her for those days she is not working for you.}
Just wondered will my current maid's working visa be processed while she's still under contract with us?
{Yes, her application will be process but her new visa will not be release until your contract with her had finished and the Immigration received your release letter.}
My agent says I cannot contact immigration until a file number is issued. Is that true? Can I contact the immigration based on the DH contract no?
{Not really, as long as the employer have the applicant's name, passport number and date of birth employer can make enquire with the Immigration.}
Her contract and paperwork and supporting letter to speed up the process were submitted to the immigration on 22nd Jan for approval.....Or is there anyway I could speed up the visa application as it's been 2 weeks of waiting.
{I assume your supporting letter is the Request for Urgent Visa Processing letter. You can ask you agent to submit again that letter one more time or go to the Immigration office directly to speak to the Officer. Frankly, if your documents were really submitted on 22 Jan, you should had already received the Acknowledgement Card (White Card) with your file reference number. Please reconfirm with your agent on the submission date.}
Was told by agent that as soon as the visa is issued my new maid could start her training.
{Not true, training can start immediately after the contract released from the Consulate in HK. Did you ask your agent if they said training can only start after the visa is issued, then WHEN can your new maid arrive?}
is it okay if we make agreement with her to let her leave early instead of 4 March 2007? Is there anything we need to pay attention?
Do you have any sample letter for the agreement of early release?
{There is no such sample letter for your case. My suggestion is, provided that you maid also agreed, to ask her write another one-month notice and back date it e.g. the letter issue date is 10 Jan and last day is 9 Feb. If she don't agree, another way is to simply compensate her for the remaining days (paid up till 4 March) and ask her to leave immediately.}
Sorry if I confuse you. The situation is my maid's employment contract/visa ends on 28th Feb. She has tendered her resignation to leave on 20th.
Sorry I got a few more questions
When my maid signs off all outstanding payments due to her on her last day, do I need to give her a copy?
I've have always paid my maid in cash but on her final pay, could I pay her by a cash cheque? My hubby says it would arouse suscipion and raise questions (that if she files a complaint at the labour dept) if all along we paid cash and then final payment is by cheque. Is he being silly? The amount due to her is quite substantial.
I dunno if this is a silly question but on my maid's last day, I want to check her bags before she leaves for good in case she takes our stuff. Could she sue me for invasion of privacy? Do I have a right to search her bags? My maid had previously stolen from me and I have a big trust issue with her.
I've checked with my agent and the submission date was 25th and not 22nd. The agent hasn't heard anything as yet.
With my new maid - I took the risk of hiring her without a reference. From her track record, she completed 2 contracts with the same employer (per her visa chops in her passport). I would like to contact her previous employer but agent says it's not possible. Is the agent lying or are there anyway around it?

I know that my new maid's contract has been approved by the Consualte before being submitted to the immigration. My agent mentioned what I quoted above and reckons my new maid will arrive around April. From what I've been told, it all depends how soon the visa is processed before she starts her training.
I made a set of house rules for my new maid. At the paper work, I wrote that she should follow the rules, and my house has a web cam installed in our sitting room area. But, I am worry. Will I 違 反私 隱 in using the cam. Should I give her a copy of above notes? Because I want her to keep in mind in regarding the rules. Please give me comment. Thanks!
I just employed a Filipino maid who is 24 years old. She wants to take leave for vacation in coming April. I worry whether she can return back to HK because she is 24 years old only. Any comment, please
