My maid's employment contract/visa ends on 28th Feb. She has tendered her resignation to leave on 20th.
{I understand now. But that is not a resignation. It is still a finish contract with early release as I had explained in previous reply to you.}

When my maid signs off all outstanding payments due to her on her last day, do I need to give her a copy?
{I would recommend you to give her a copy. It is just like getting a receipt when you made a purchase from supermarket, no big deal about it.}

could I pay her by a cash cheque?
{By law, you can insist to pay her in Cash Cheque or Cross Cheque. But to avoid any further complication, I would recommend to give her in cash like usual. Just remember to get her sign the salary payment slip like usual with the stated amount. If you want to make it even safer, get a witness to be there when she receive it or you can even set a video camera to record the event.}

Do I have a right to search her bags?
{You can ask her to show you all the things that she is taking away with her. But DO NOT touch any of her belonging with your own hands. Just ask her to show you all the things herself. Set up a video recorder to record the event if you want.}

I would like to contact her previous employer but agent says it's not possible. Is the agent lying or are there anyway around it?
{I assume you had seen the passport visa chop yourself to verify the working period as she had claimed. The rest you can only take your agent word for it.}

My agent....reckons my new maid will arrive around April. From what I've been told, it all depends how soon the visa is processed before she starts her training.
{I totally disagree. My stand is still as per previous reply. In my standard, your maid should arrive in March already.}

my house has a web cam installed in our sitting room area. But, I am worry. Will I 違 反私 隱 in using the cam.
{If you are worried about your maid having an issue with this, just inform her that the webcam is for security reasons. You can include it in your house rule to mention about the webcam. You can give the copy to your agent and ask your agent to get her to sign. Just be sure the rules does not infringe any of the HK Labour Law.}

{A word of advice. The maids nowadays are very selective in accepting job from employer too. I would suggest that you don't show her your house rule before she arrive. Maybe your intention is just to make clear about things she can/cannot do but it will only scare them off and turn down your job. Your previous maid reject your employment could be due to this reason. They also have choices to choose their employer too. If you want, you can email me your house rule to [email protected], I can comment for you further.}

I worry whether she can return back to HK because she is 24 years old only.
{No worries about this now. The new regulation had changed the minimum age to 23 years old and below. Moreover, from my understand, this does not concern those who are already working in Hong Kong who are going back for holiday or recontract.}

Mid. Nov -- sign contract

Mid. Dec. -- My husband phone to HK IMM dept. for VCA no. The HK IMM dept. replied no such application.

Mid. Dec. -- Phone to agent and ask for why HK IMM dept. replied no such application. Agent replied the maid who you employ is on bad list in Indonese cons. But actually find that her name is the same to the other one on bad list. And agent promised will send application to HK IMM dept. tomorrow.

Three day later -- send to HK IMM dept

Early Jan -- got VCA No.

Then -- My husband sent urge letter

Mid Jan -- visa issued

Me and my husband hope the maid will arrive before 29 Jan since I take two weeks holiday to train the maid.

The first reason that the agent reply for the maid can't arrive --The maid can't arrive on this week since she need to wait for cheaper air ticket. And the air flight is very full since it is near to Chinese new year.

Then I wait for next week.

The next week agent reply that the maid can't come since her family member dead. But she will come next week. You wait la.

The 3rd week agent reply the maid still not come back to training centre. Her family member get sick.
( sick not dead) Agent ask me to wait for the maid or choose another one. I ask for refund and agent rejected. Agent said she already do the thing she need to do and nothing wrong. I said why you send the application to HK IMM. dept. late for a month? She reply because the maid passport overdue. ( not on bad list in Indonese cons)

My two weeks holiday already past. My two little child no one to take care ( 2 years old boy and 2 months girl) How can I do? I don't want to choose another maid at that agent. I can't wait for that maid. I don't want to lose the agent fee $2888.

{There is no such sample letter for your case. My suggestion is, provided that you maid also agreed, to ask her write another one-month notice and back date it e.g. the letter issue date is 10 Jan and last day is 9 Feb. If she don't agree, another way is to simply compensate her for the remaining days (paid up till 4 March) and ask her to leave immediately.}

I need a maid in mid April. Now I have found a local Phillippine maid who will be early released in eary March. I know it takes about a month for the HK Immigration to process her visa. As she is a terminated one, does she have to go back to her home country and wait for the new working visa? In that case, do I have to buy her theflight ticket from Philippine to HK when she comes to work for me?

我剛剛與bunbun再續約兩年, 並將於2月14-28日放假返菲律賓. 佢今日俾封信我老公想我老公簽, 信內容寫證明佢在我家工作已工作兩年,並照顧新生嬰兒, 及做家務,買餸,洗衫等. 亦包括寫明2月14-28日是放大假.

她說是用來返來香港時展示予菲律賓入境處用的. 但我的bunbun agent, 及我買機票時的travel agent根本無提及過需要這封信.

想請問是否真的需要這封信予菲律賓入境處呢? 其實佢passport度都已經寫明了佢是來做housemaid架喇, 仲有埋contract no. 而且封信任何人都簽得架喇, 可以證明到d乜?!

Thank you for your advice.

The immigration has issued the file no for my new maid's application. Now awaiting issuance of visa.

My current maid is being very troublesome. As I mentioned previously, she had tendered a written resignation letter to leave on 20th Feb. Now she wants to change the date to 23rd. I have a suspicion she'd be working for her new employer illegally while she's waiting for her new visa as she mentioned her new employer told her to leave on 23rd instead. I am sick of all these date changes as it is now the 5th time - the first 3 times were verbal resignation (15th, 10th and 21st) and the 4th time was when we requested a written resignation (confirmed as 20th). By law, can we refuse to accept further changes to her resignation letter. I was going to use her written resignation letter to speed up the process of my new maid's visa.

Sorry to trouble you yet again.

我個印尼工人將於16號到港, agent當日會同佢整埋身分證, 並叫我們5-6點去接工人, 想問:

1) 16號當日要不要出糧?
2) 是否半年內的紅色假期都不需要補錢給工人? 即我只需每個月俾3400?
3) 應該幾時帶工人驗身?

1) 我e+個印係我 05年4月1日上 agency 到接佢番來。錦係咪下個月 3月31日就係佢 last day. if 我唔用佢1個月通知期，that means 今個月28要話佢知， right????
還有, 到3月尾我同佢滿左lee份約埋單係咪 encl .. 3月份人工、單程機票、膳食及交通allowance。 至於遣散費係咪要俾？ 係咪錦計 (3270 x 2/3 x 2 Year), 錦咪$4360？ 未曾享用的年假薪酬又點計呢？

賓賓會在08年7月約滿，但我想在０７年１２月提前解約，可以嗎？需要充份理由嗎？

因仔仔會讀全日制幼兒園，我有婆婆幫手，所以唔需要佢，反正佢表現一般，我想請鐘點

我有什麼要做？要賠償嗎？佢可以唔同意提前解約嗎？如果佢唔同意禁點算？

I have some question want to solve, please help me.

(1) I sign the contract with maid on 4/1/2007 and submit the Employment Contract to Philippine Consulate General, HKSAR on 9/1/2007. But they only give back me the Employmnet Contract, my maid tell me they will be give me a yellow paper if I provide the certificate of employment stating position and monthly salary. Can you tell me what means the yellow paper because I am not yet to get back the yellow paper and can I unit the wokring visa issued and to get the yellow paper together and sent it to my maid (because my maid is in Philippine now).

(2) I already sent all the documents to HK Immigration Department and they also sent back the acknowledgement card to me. I just waiting the working visa. It is becasue all the process is doing by myself. When I get the working visa, I will sent the visa to Philippine for my maid and the yellow paper. Can you tell me that if my maid receipt my documents, is she can go to HK by herself, and no need to full the agency. And what point she need to note?

(3) And I think my visa may be issue at end of February. Can I tell she go to HK first until the visa issued?

(4) I also want to know that my maid is need to many exam. in Phi. or new policy is effect for her? My maid have experience in HK more than 5 year. But now I sign with her contract is new contract.

Hi Mrs Rose

Our contract with our Indonesian Maid will end this June. Her main job is to take care of my 18 months old girl. Both my husband and me is working full time.

Last year end, she said she wanted to go home earlier with her friend in April and we agreed. Last month, when we talked about it again she said she wants to go back in June instead. I said I could not take vacation in June and she said she might not want to renew contract. I told her if this is true I will look for a new maid soon as I want some transition period.

Last Week, I asked her again and she said she will renew the contract under the condition of (1) a day off every week in next contract and (2) we borrow her $15,000 in March for her to buy the grocery store her mother in law owned (she passed away last week). And she will take 2 weeks vacation back to Indonesia in April. The money could be deducted from her salary.

She is very nice to my daughter and cooks ok. I am not sure if we should borrow her the money and if she will come back. Please advise what should we do.

I have a question and hope you can help me. I have just employed a new Indonesian helper. I would like to know if she is entitled to get paid for the Chinese New Year Holiday which includes Feb. 17-20. I learned from my friends that for the first 3 months of employment contract, the maid cannot take ALL labour holiday with fully paid. Is this correct? Or is she entitled to get all labour holiday paid? Please kinldy help.

I would like to know if a maid, working 10 years under the same employer, chooses not to renew contract and signs a resignation letter, does the employer still needs to pay her long service payment under HK law?

Do I need to pay OWWA (Overseas Workers Welfare Association)?
