Did your maid really have one day off per week?
Or you just ask her to sign the day off .Although you've a document to prove it, it's not a fact.

My case is ....LAst Year...

All the process are followed the Labour Dep't... fully payment & one day off per week.And we also ask her to sign every payment & hoilday off.
At last , she said she was underpaid.

( I think most of the maid need to pay the commission to the agency at the start of few months.)
Thus, we need to handle this at court. It's quite bother our life. And the story ending is .. .. I need to pay more money to her .. (the amount is the commission to the agency).

BTW,you can pm your case to me if you wish.I can ask my friend who is solicitor.

我之前個印印都ＯＫ!係無記性Ｄ,Ｅ+轉左小菲.
但聽你地甘講,真係好差ＬＡ!都係用小菲好,唔冼比人無告underpay.

I don't understand that, you need to give pay more. You had given full-pay salary to her, suppose that, there is record to prove that you had given. How did the maid said, you are underpay?

家o下咩証明都有, 如果個官都要你比錢的話, 咁就真係好唔合理呀! 咩都比足佢, 佢自己走佬, 佢無証明o地話你underpaid& 削佢假期, 咁都win 的話, 香港人真係咩工人都唔好請, 反正佢o地玩晒!
佢o地輸之後, 應該要佢o地比返堂費, 浪費我們所有納稅人的錢!!!!! 重要陪返你要再找工人的費用, 你請假的費用 etc, 唔係邊有阻嚇性喎!

I really fully paid & followed the employment rules to the maid. I just hired this maid about 5 months.As the start of second month, she always unhappy & feel unfair to pay most of her salary (commission)to the agency. During that period, my husband & I always talk with her nearly every night. I decide to fire her until we find that she is very very careless as taking my baby. Moreover, her personal hygiene is very bad.

Of course , she didn't accept this fact. Then we need to settle in the court.

Finally, I really need to pay extra (amount of 5 months'commission) to the maid. And the agency agree to share those money with me....
I need to pay that money to the maid because the maid really didn't get her all salary each month.The most important is ... I pay some of the money to the maid & some to the agency (her commission).
Although I make all payment records (amount & date, holiday), it's not the FACT (amount of salary which the maid gets ).

(p.s I consult my friend (solicitor) as I receive the letter from court)

oh! How come you give the commission to agency?
Even the maid needs to pay the commission, it is her business, not your business.
Therefore, you must give full salary to your maid, let her do it herself, not you.

Totally I did paid HKD3320 on every month 1st to her Hang Seng bank account which is under her name, not agent. And she said she has never receive the money by ATM card or even the accout book. How do I know the dealing in business between her and the agent? My liability just need to pay her salary after month by month. And the payment slip is signed when I noted her by after I on-line to pay her salary.

我個工人今天是 last day (斷約, 只做了兩個月, full pay, 一個月放四天假), 今早五時半偷走了, 原來之前佢已逐步送走自己的衣物, 今早早更的管理員話唔覺佢有帶行李, 仲要手提包都沒有.

我今天已做了以下的事:
--一大早打電話到警局想報案, 但警察話唔受理, 工人唔見 2
2~3小時而已.
--九時半親身交"中止合約信"給入境署外傭組, 自己 keep
一份copy (有入境署的日子印)
--通知agent, 可以點做? (答:等下先, 24小時後再報警,
之後通知入境署)
--問勞工署可以點做? (報警, 通知入境署, 如要有 record就
要把事件變為case, 例如向工人追討今日的欠假, 不過才
一天, 好像小題大做了)
--再問 agent 工人有沒有出現? (當然沒有)
--傍晚時終於去報警備案?

請問有經驗的媽咪, 我有沒有做漏些甚麼?

MavisNg: I know my maid has to pay comission to her Indonesian agent every month $3000 for the first 6 months. I pay my maid by cash and she signed the slip for me. Then, she'll go to 7-11 to pay the loan to the agent. Do you think it help to avoid yr problem?

請講清楚 D！

如果合約的 last day 都偷走了。
佢大可以話佢以為今天可以走得，所以一早走人。
這只是一場誤會而言。
可是，你已經同佢上左 Agent 未？可否講得清楚詳細少少？

No la, I pay the salary via her name account also can go to the labour dept. If u pay by cash, no bank slip...She can also say nothing has received. My slip is signed by her with the holiday details, she said she has not sign for everthing by her own.

做得2個月,好明顯唔係合約的last day啦, 合約一定係2年架嘛!!!!!

人地都係想得到大家既正確資料/經驗之談, 未請過工人又唔識勞工法例同入境條例但要扮專家教人，未免太過份.

如果你諗攞人地既慘事黎討論而增加自己既知識又或者好似你所講幫人，咁唔該你寫清楚同讀下先,唔係人地照你所講既去做,真係害人不淺,損失唔係你呀嘛.....我都係過來人,個種金錢同精神上既損失,你點會明,如果你明,你又點會係度點人!!!!由個次後,有咩我都唔會再上來bk問,直接打去LB問重好.

我工人是斷約的, 上個月我給她一個月通知(連一個月通知, 總共只做了兩個月), 昨天(6/5)是 last working day , 即是今天(7/5)才是離開的日子. 之前都同個工人一起看月曆, 解釋清楚, 點誤會都唔會一早五點半就走人卦?
本來打算昨天傍晚和她一起上 agent 攪清手續, 交收一切,如今都唔知點做.
上個月的人工我是用銀行過戶給她, 亦已簽收了人工及假期,
今個月的人工應該是昨天出糧的, 但不能再過戶了, 因她已取消了自己的戶口.

其實我有D好奇,我見你係其他topic講到個agency咁好,點解你唔叫佢跟???我個單野都係個新agency幫我follow(因為我個死bun係自己請所以無舊agency),佢重幫我整埋文件,教我點回答......個次係我第一次請工人,咩都唔識,始終佢地係專業,一定好過我地d c9仔.真係好彩個agency肯follow,如果唔係,我真係唔知點,個時真搞到我想死....

個agent根本無得follow, 個妹無同agent接觸過, 而一走之後就去咗公會, 佢已經比人洗哂腦, 佢無可能响agent身上攞到機票及好處(況且以我所知, 佢未還完錢比agent), 佢梗唔會搵agent啦, 而佢上勞工署, 無非係為錢, 所以佢點會唔告
