My Indo helper contract will be ended in June and I am looking for a Phil Helper.

My friend's maid refer a helper to me, Ms C. Ms C contract with her current employer will end in Sep while her current employer terminate her contract in March with 1 month notice, so her contract will be ended in Apr. I have some questions.

***If I employ Ms. C, whether I can do it without agent? If so, what's the procedure and cost

If they permits, they will tell you the next procedure how to process. Meanwhile, when you get the contract & forms from HK Immigration they will also enclosed a guildline to teach you how to apply for the domestic helper visa. Cost: Contract $297.50, HK visa fee$160, Phil POEA $600 and airticket from Phil to HK $1,000. My suggestion is to process it through Agent as it is very tedious work and time consuming. Some Agent charge only HK$2500-3000.}

***Ms C will be backed to Phil since she was terminated, I need her to be backed in Jun, so when shall I start to do the new contract with immigration?

因為不滿工人表現，我將會在四月尾炒工人，但俾一個代通知金真係好肉痛，工人係我度己做接近6個月，如我炒佢，應該仲要俾佢3日大假錢，我想可以俾少D盡量俾少D。所以我想Easter時額外叫佢放左個3日大假，如果工人同意的話，咁我正式炒佢時，就不需再補錢俾佢。請問合法嗎？

1) My friend recommend me a Philino maid which she want to terminate the contract with her. The maid has been working for her for 1 year. My friend wants to terminate her in the reason of Financial Problem which the maid no need to go back to Philippines. But my friend also has another maid under her name. 2) Originally, I have applied a maid from overseas, but she didn’t show up, the agent told me that she broke her leg & can’t come. I think this is only an excuse that the maid doesn’t come. Under this reason, can I ask a refund from the agent or what I can do to get back the agent fee?

{That depends on the agreement conditions that you had signed when you engaged them for service. Have you tried talking to your agent?Normally the agent will do refund. If they are unreasonable, you can approach the Consumer Council for assistance.}
