1) If I decided to employ this new maid (yet she still have a contract with another employer), can I do it by myself to sign her up without going through agency (as I already wasted a lot of money on it, this is third trial)? How long does it takes? Does she needs to go back to phil to file the case as an new application? Is there any training she need to attend?

ANS:{You can process it yourself. The process is 6 to 8 weeks. As she break/terminate her contract with her employer, she will have to depart Hong Kong. If she had finished/completed at least one contract in Hong Kong she can be exempted from training and test.}

2) Or if I choose to go through my existing agency (say I've right to get an overseas replacement). Can I just giving them administration fee for this application? The new maid is very concern about the agency fee on her part, do you think she need to pay money for that? any how much will it cost?

ANS:{You have to check with your agent about the charges.}

3) which one is the faster way? I really in a rush?

ANS:{Agent can definately process it faster then doing it yourself. Anyway, the agency charges is not expensive comparing with the time and expenses occured by doing it yourself. Market charges is around HKD3000-3500.}

4) Depends on the situation, I may keep the old maid at the moment until the new maid comes, what do you think, it is too dangerous / annoyance brought from the loan shark?

ANS:{Normally, the loan shark won't bother the employer. But if the creditor can trace to your address, she have to continue to pay them to avoid you terminating her due to their disturbance. You should talk to your maid to ask if she is willing to continue making the payment, if not, it would be better that you terminate her immediately.}

(1) Do i need to pay her annual leave (prorata)? even though she just worked for me for 5 months?

ANS:{Yes, as long as she had completed her first 3 months.}

(2) She lives in Manado Indonesia. Travel agent tells me there's no open ticket, so need to buy ticket with a date but can change date with no charge. What date should I buy? If she miss her flight, do I need to buy her another ticket?

ANS:{You can buy the flight date to be on 12th or 13th April. But make sure it is valid for at least 14 days so even if she miss her flight she can still change without extra charges.}

ｂｕｎｂｕｎ　６月１５日滿約４年，會續約，但她會在５月１１日回ｐｈｉｌｉｐｐｉｎｅｓ，１８號回來，２１號會去攪續約，可否在續約前驗孕先，如有孕，可否不與她續約，須否賠償？

ANS:{在續約前驗孕先，如有孕，可以不續約，不須賠償。佢18/5先返，6月頭就要續約，咁快未知有冇孕架喎。

另如２１號自行攪續約，是否夠時間？

2. If my new maid is under 25yrs old now, after I terminate her, does she need to go back Philipines absoulately?

ANS:{The age limit had been changed to minimum 23 years old. All terminated maid have to exit Hong Kong.}

2. My old maid may be want to go back HK work for me again. If I direct hire for her, does she need to attend the training course and pass the exam in Philipines.

ANS:{As long as had completed at least one full contract term before in Hong Kong she can be exempted from the training and exam.}

3. My friend told me that one agency process the direct hire application just require the employer to pay the fee (~HK$32xx), and no need the maid to pay any agency fee in philipines. Is it true?

ANS:{True. Market price around HKD3000 to HKD3500.}

4. If I find another contract finishing maid already in HK. When they changing the new employer in HK, do they need to go back to Philipines again? That means I cannot find the maid in a short time and already in HK?

ANS:{If she is finished-contract, she don't have to go back. But she have to get her new employment visa before she can start working legally with the new employer. Time to get visa is around 3-4 weeks from date of application at HK Immigration.}

I paid 6 months $2400 the levy for the old bun bun,
but after two months, she leave. Now I found the
new bun bun. I want to know how much the levy

ANS:{Levy is HKD400 per month. So you just have to pay additional HKD800.}
